88 AN ACT
99 relating to a common characteristic or use project in a public
1010 improvement district in certain municipalities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 372.0015, Local Government Code, is
1313 amended to read as follows:
1414 Sec. 372.0015. DEFINITIONS [DEFINITION]. In this
1515 subchapter:
1616 (1) "Extraterritorial[, "extraterritorial]
1717 jurisdiction" means extraterritorial jurisdiction as determined
1818 under Chapter 42.
1919 (2) "Hotel" has the meaning assigned by Section
2020 156.001, Tax Code.
2121 SECTION 2. Section 372.005, Local Government Code, is
2222 amended by amending Subsection (b-1) and adding Subsection (b-2) to
2323 read as follows:
2424 (b-1) A person is a qualified petitioner under Subsection
2525 (b-2) if the person:
2626 (1) is employed in a management position responsible
2727 for overseeing the operations of a hotel, including:
2828 (A) the owner or general manager of a hotel;
2929 (B) a regional manager who oversees the
3030 operations of a hotel; or
3131 (C) an employee of a management company who
3232 oversees the operation of a hotel; and
3333 (2) affirms by affidavit that the person is authorized
3434 to enter into a contract on behalf of a hotel.
3535 (b-2) Notwithstanding Subsection (b), a petition for the
3636 establishment of a public improvement district described by Section
3737 372.0035(a) or (a-1) is sufficient only if the petition is:
3838 (1) signed by qualified petitioners who represent
3939 [record owners of taxable real property liable for assessment under
4040 the proposal who constitute:
4141 [(1)] more than 60 percent of the appraised value of
4242 hotel [taxable real] property liable for assessment under the
4343 proposal, as determined by the current roll of the appraisal
4444 district in which the property is located,[;] and who:
4545 [(2) more than 60 percent of:]
4646 (A) represent more than 60 percent of all hotels
4747 [all record owners of taxable real property] that are liable for
4848 assessment under the proposal; or
4949 (B) represent more than 60 percent of the area of
5050 all taxable real property that is liable for assessment under the
5151 proposal; and
5252 (2) accompanied by an affidavit described by
5353 Subsection (b-1)(2) for each qualified petitioner signing the
5454 petition.
5555 SECTION 3. Section 372.005, Local Government Code, as
5656 amended by this Act, applies only to a petition for the
5757 establishment of a public improvement district filed on or after
5858 the effective date of this Act. A petition filed before the
5959 effective date of this Act is governed by the law in effect on the
6060 date the petition is filed, and the former law is continued in
6161 effect for that purpose.
6262 SECTION 4. This Act takes effect immediately if it receives
6363 a vote of two-thirds of all the members elected to each house, as
6464 provided by Section 39, Article III, Texas Constitution. If this
6565 Act does not receive the vote necessary for immediate effect, this
6666 Act takes effect September 1, 2025.
