10 | 10 | | improvement district in certain municipalities. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 372.0015, Local Government Code, is |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | Sec. 372.0015. DEFINITIONS [DEFINITION]. In this |
---|
15 | 15 | | subchapter: |
---|
16 | 16 | | (1) "Extraterritorial[, "extraterritorial] |
---|
17 | 17 | | jurisdiction" means extraterritorial jurisdiction as determined |
---|
18 | 18 | | under Chapter 42. |
---|
19 | 19 | | (2) "Hotel" has the meaning assigned by Section |
---|
20 | 20 | | 156.001, Tax Code. |
---|
21 | 21 | | SECTION 2. Section 372.005, Local Government Code, is |
---|
22 | 22 | | amended by amending Subsection (b-1) and adding Subsection (b-2) to |
---|
23 | 23 | | read as follows: |
---|
24 | 24 | | (b-1) A person is a qualified petitioner under Subsection |
---|
25 | 25 | | (b-2) if the person: |
---|
26 | 26 | | (1) is employed in a management position responsible |
---|
27 | 27 | | for overseeing the operations of a hotel, including: |
---|
28 | 28 | | (A) the owner or general manager of a hotel; |
---|
29 | 29 | | (B) a regional manager who oversees the |
---|
30 | 30 | | operations of a hotel; or |
---|
31 | 31 | | (C) an employee of a management company who |
---|
32 | 32 | | oversees the operation of a hotel; and |
---|
33 | 33 | | (2) affirms by affidavit that the person is authorized |
---|
34 | 34 | | to enter into a contract on behalf of a hotel. |
---|
35 | 35 | | (b-2) Notwithstanding Subsection (b), a petition for the |
---|
36 | 36 | | establishment of a public improvement district described by Section |
---|
37 | 37 | | 372.0035(a) or (a-1) is sufficient only if the petition is: |
---|
38 | 38 | | (1) signed by qualified petitioners who represent |
---|
39 | 39 | | [record owners of taxable real property liable for assessment under |
---|
40 | 40 | | the proposal who constitute: |
---|
41 | 41 | | [(1)] more than 60 percent of the appraised value of |
---|
42 | 42 | | hotel [taxable real] property liable for assessment under the |
---|
43 | 43 | | proposal, as determined by the current roll of the appraisal |
---|
44 | 44 | | district in which the property is located,[;] and who: |
---|
45 | 45 | | [(2) more than 60 percent of:] |
---|
46 | 46 | | (A) represent more than 60 percent of all hotels |
---|
47 | 47 | | [all record owners of taxable real property] that are liable for |
---|
48 | 48 | | assessment under the proposal; or |
---|
49 | 49 | | (B) represent more than 60 percent of the area of |
---|
50 | 50 | | all taxable real property that is liable for assessment under the |
---|
51 | 51 | | proposal; and |
---|
52 | 52 | | (2) accompanied by an affidavit described by |
---|
53 | 53 | | Subsection (b-1)(2) for each qualified petitioner signing the |
---|
54 | 54 | | petition. |
---|
55 | 55 | | SECTION 3. Section 372.005, Local Government Code, as |
---|
56 | 56 | | amended by this Act, applies only to a petition for the |
---|
57 | 57 | | establishment of a public improvement district filed on or after |
---|
58 | 58 | | the effective date of this Act. A petition filed before the |
---|
59 | 59 | | effective date of this Act is governed by the law in effect on the |
---|
60 | 60 | | date the petition is filed, and the former law is continued in |
---|
61 | 61 | | effect for that purpose. |
---|
62 | 62 | | SECTION 4. This Act takes effect immediately if it receives |
---|
63 | 63 | | a vote of two-thirds of all the members elected to each house, as |
---|
64 | 64 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
65 | 65 | | Act does not receive the vote necessary for immediate effect, this |
---|
66 | 66 | | Act takes effect September 1, 2025. |
