77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to artificial intelligence training programs for certain
1010 employees and officials of state agencies and local governments.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.175(h-1), Education Code, is amended
1313 to read as follows:
1414 (h-1) Notwithstanding Section 2054.5191, Government Code,
1515 only the district's cybersecurity coordinator is required to
1616 complete the cybersecurity training and the artificial
1717 intelligence training under that section on an annual basis. Any
1818 other school district employee required to complete the
1919 cybersecurity training and the artificial intelligence training
2020 shall complete the training as determined by the district, in
2121 consultation with the district's cybersecurity coordinator.
2222 SECTION 2. The heading to Section 772.012, Government Code,
2323 is amended to read as follows:
2424 Sec. 772.012. COMPLIANCE WITH CYBERSECURITY AND ARTIFICIAL
2525 INTELLIGENCE TRAINING REQUIREMENTS.
2626 SECTION 3. Sections 772.012(b) and (c), Government Code,
2727 are amended to read as follows:
2828 (b) To apply for a grant under this chapter, a local
2929 government must submit with the grant application a written
3030 certification of the local government's compliance with the
3131 cybersecurity training and the artificial intelligence training
3232 required by Section 2054.5191.
3333 (c) On a determination by the criminal justice division
3434 established under Section 772.006 that a local government awarded a
3535 grant under this chapter has not complied with the cybersecurity
3636 training or the artificial intelligence training required by
3737 Section 2054.5191, the local government shall pay to this state an
3838 amount equal to the amount of the grant award. A local government
3939 that is the subject of a determination described by this subsection
4040 is ineligible for another grant under this chapter until the second
4141 anniversary of the date the local government is determined
4242 ineligible.
4343 SECTION 4. The heading to Subchapter N-1, Chapter 2054,
4444 Government Code, is amended to read as follows:

4747 Code, is amended to read as follows:
4848 Sec. 2054.5191. CYBERSECURITY AND ARTIFICIAL INTELLIGENCE
4949 TRAINING REQUIRED: CERTAIN EMPLOYEES AND OFFICIALS.
5050 SECTION 6. Sections 2054.5191(a), (a-1), (b), (c), and (e),
5151 Government Code, are amended to read as follows:
5252 (a) Each state agency shall identify state employees who use
5353 a computer to complete at least 25 percent of the employee's
5454 required duties. At least once each year, an employee identified by
5555 the state agency and each elected or appointed officer of the agency
5656 shall complete a cybersecurity training program certified under
5757 Section 2054.519 and an artificial intelligence training program
5858 certified under Section 2054.5193.
5959 (a-1) At least once each year, a local government shall:
6060 (1) identify local government employees and elected
6161 and appointed officials who have access to a local government
6262 computer system or database and use a computer to perform at least
6363 25 percent of the employee's or official's required duties; and
6464 (2) require the employees and officials identified
6565 under Subdivision (1) to complete:
6666 (A) a cybersecurity training program certified
6767 under Section 2054.519; and
6868 (B) an artificial intelligence training program
6969 certified under Section 2054.5193.
7070 (b) The governing body of a local government may select the
7171 most appropriate cybersecurity training program certified under
7272 Section 2054.519 and the most appropriate artificial intelligence
7373 training program certified under Section 2054.5193 for employees
7474 and officials of the local government to complete. The governing
7575 body shall:
7676 (1) verify and report on the completion of a
7777 cybersecurity training program and an artificial intelligence
7878 training program by employees and officials of the local government
7979 to the department; and
8080 (2) require periodic audits to ensure compliance with
8181 this section.
8282 (c) A state agency may select the most appropriate
8383 cybersecurity training program certified under Section 2054.519
8484 and the most appropriate artificial intelligence training program
8585 certified under Section 2054.5193 for employees of the state
8686 agency. The executive head of each state agency shall verify
8787 completion of a cybersecurity training program and an artificial
8888 intelligence training program by employees of the state agency in a
8989 manner specified by the department.
9090 (e) The department shall develop a form for use by state
9191 agencies and local governments in verifying completion of
9292 cybersecurity training program and artificial intelligence
9393 training program requirements under this section. The form must
9494 allow the state agency and local government to indicate the
9595 percentage of employee completion.
9696 SECTION 7. Subchapter N-1, Chapter 2054, Government Code,
9797 is amended by adding Section 2054.5193 to read as follows:
9898 Sec. 2054.5193. STATE-CERTIFIED ARTIFICIAL INTELLIGENCE
9999 TRAINING PROGRAMS. (a) The department, in consultation with the
100100 cybersecurity council established under Section 2054.512 and
101101 interested persons, shall annually:
102102 (1) certify at least five artificial intelligence
103103 training programs for state and local government employees;
104104 (2) update standards for maintenance of certification
105105 by the artificial intelligence training programs under this
106106 section; and
107107 (3) ensure that the artificial intelligence training
108108 programs are equal in length to the cybersecurity training programs
109109 certified under Section 2054.519.
110110 (b) To be certified under Subsection (a), an artificial
111111 intelligence training program must:
112112 (1) focus on forming an understanding of how
113113 artificial intelligence technology may be used in relation to a
114114 state employee's responsibilities and duties; and
115115 (2) teach best practices on literacy in deploying and
116116 operating the artificial intelligence technologies.
117117 (c) The department may identify and certify under
118118 Subsection (a) training programs provided by state agencies and
119119 local governments that satisfy the training requirements described
120120 by Subsection (b).
121121 (d) The department may contract with an independent third
122122 party to certify artificial intelligence training programs under
123123 this section.
124124 (e) The department shall annually publish on the
125125 department's Internet website the list of artificial intelligence
126126 training programs certified under this section.
127127 SECTION 8. Section 2056.002(b), Government Code, is amended
128128 to read as follows:
129129 (b) The Legislative Budget Board and the governor's office
130130 shall determine the elements required to be included in each
131131 agency's strategic plan. Unless modified by the Legislative Budget
132132 Board and the governor's office, and except as provided by
133133 Subsection (c), a plan must include:
134134 (1) a statement of the mission and goals of the state
135135 agency;
136136 (2) a description of the indicators developed under
137137 this chapter and used to measure the output and outcome of the
138138 agency;
139139 (3) identification of the groups of people served by
140140 the agency, including those having service priorities, or other
141141 service measures established by law, and estimates of changes in
142142 those groups expected during the term of the plan;
143143 (4) an analysis of the use of the agency's resources to
144144 meet the agency's needs, including future needs, and an estimate of
145145 additional resources that may be necessary to meet future needs;
146146 (5) an analysis of expected changes in the services
147147 provided by the agency because of changes in state or federal law;
148148 (6) a description of the means and strategies for
149149 meeting the agency's needs, including future needs, and achieving
150150 the goals established under Section 2056.006 for each area of state
151151 government for which the agency provides services;
152152 (7) a description of the capital improvement needs of
153153 the agency during the term of the plan and a statement, if
154154 appropriate, of the priority of those needs;
155155 (8) identification of each geographic region of this
156156 state, including the Texas-Louisiana border region and the
157157 Texas-Mexico border region, served by the agency, and if
158158 appropriate the agency's means and strategies for serving each
159159 region;
160160 (9) a description of the training of the agency's
161161 contract managers under Section 656.052;
162162 (10) an analysis of the agency's expected expenditures
163163 that relate to federally owned or operated military installations
164164 or facilities, or communities where a federally owned or operated
165165 military installation or facility is located;
166166 (11) an analysis of the strategic use of information
167167 resources as provided by the instructions prepared under Section
168168 2054.095;
169169 (12) a written certification of the agency's
170170 compliance with the cybersecurity training and the artificial
171171 intelligence training required under Sections 2054.5191 and
172172 2054.5192; and
173173 (13) other information that may be required.
174174 SECTION 9. As soon as practicable after the effective date
175175 of this Act, the Department of Information Resources shall adopt
176176 the rules necessary to develop and implement the artificial
177177 intelligence training programs required by Section 2054.5193,
178178 Government Code, as added by this Act.
179179 SECTION 10. This Act takes effect September 1, 2025.
