810 AN ACT
911 relating to creating the criminal offense of trespass on or near
1012 school or day-care center property.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Chapter 30, Penal Code, is amended by adding
1315 Section 30.055 to read as follows:
1416 Sec. 30.055. TRESPASS ON OR NEAR SCHOOL OR DAY-CARE CENTER
1517 PROPERTY. (a) In this section:
1618 (1) "Day-care center" has the meaning assigned by
1719 Section 42.002, Human Resources Code.
1820 (2) "Public property" includes a street, highway,
1921 alley, public park, or sidewalk.
2022 (3) "School" means a private or public elementary or
2123 secondary school.
2224 (4) "School or day-care center property" means:
2325 (A) all land and buildings owned or leased by a
2426 school or day-care center; and
2527 (B) any grounds or buildings on which an activity
2628 sponsored by the school or day-care center is being conducted.
2729 (b) A person commits an offense if the person:
2830 (1) enters or remains on:
2931 (A) school or day-care center property; or
3032 (B) public property located within 250 feet of
3133 school or day-care center property;
3234 (2) does not have:
3335 (A) a reason or relationship for entering or
3436 remaining on the property that involves custody of or
3537 responsibility for a student enrolled at the school or day-care
3638 center; or
3739 (B) written permission from an authorized
3840 representative of the school or day-care center;
3941 (3) receives a reasonable request to depart by an
4042 administrator, educator, or security personnel officer employed by
4143 the school or day-care center; and
4244 (4) fails to depart.
4345 (c) An offense under this section is a Class A misdemeanor.
4446 (d) If conduct constituting an offense under this section
4547 also constitutes an offense under another section of this code, the
4648 actor may be prosecuted under either section or both sections.
4749 SECTION 2. This Act takes effect September 1, 2025.
