11 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 14 | | SECTION 1. Chapter 30, Penal Code, is amended by adding |
---|
13 | 15 | | Section 30.055 to read as follows: |

14 | 16 | | Sec. 30.055. TRESPASS ON OR NEAR SCHOOL OR DAY-CARE CENTER |
---|
15 | 17 | | PROPERTY. (a) In this section: |
---|
16 | 18 | | (1) "Day-care center" has the meaning assigned by |
---|
17 | 19 | | Section 42.002, Human Resources Code. |
---|
18 | 20 | | (2) "Public property" includes a street, highway, |
---|
19 | 21 | | alley, public park, or sidewalk. |
---|
20 | 22 | | (3) "School" means a private or public elementary or |
---|
21 | 23 | | secondary school. |
---|
22 | 24 | | (4) "School or day-care center property" means: |
---|
23 | 25 | | (A) all land and buildings owned or leased by a |
---|
24 | 26 | | school or day-care center; and |
---|
25 | 27 | | (B) any grounds or buildings on which an activity |
---|
26 | 28 | | sponsored by the school or day-care center is being conducted. |
---|
27 | 29 | | (b) A person commits an offense if the person: |
---|
28 | 30 | | (1) enters or remains on: |
---|
29 | 31 | | (A) school or day-care center property; or |
---|
30 | 32 | | (B) public property located within 250 feet of |
---|
31 | 33 | | school or day-care center property; |
---|
32 | 34 | | (2) does not have: |
---|
33 | 35 | | (A) a reason or relationship for entering or |
---|
34 | 36 | | remaining on the property that involves custody of or |
---|
35 | 37 | | responsibility for a student enrolled at the school or day-care |
---|
36 | 38 | | center; or |
---|
37 | 39 | | (B) written permission from an authorized |
---|
38 | 40 | | representative of the school or day-care center; |
---|
39 | 41 | | (3) receives a reasonable request to depart by an |
---|
40 | 42 | | administrator, educator, or security personnel officer employed by |
---|
41 | 43 | | the school or day-care center; and |
---|
42 | 44 | | (4) fails to depart. |
---|
43 | 45 | | (c) An offense under this section is a Class A misdemeanor. |
---|
44 | 46 | | (d) If conduct constituting an offense under this section |
---|
45 | 47 | | also constitutes an offense under another section of this code, the |
---|
46 | 48 | | actor may be prosecuted under either section or both sections. |
---|
47 | 49 | | SECTION 2. This Act takes effect September 1, 2025. |
