77 AN ACT
88 relating to certain criminal offenses concerning the unlawful
99 transfer or purchase of certain weapons; increasing a criminal
1010 penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 46.06, Penal Code, is
1313 amended to read as follows:
1414 Sec. 46.06. UNLAWFUL TRANSFER OR PURCHASE OF CERTAIN
1515 WEAPONS.
1616 SECTION 2. Section 46.06, Penal Code, is amended by
1717 amending Subsections (a), (c), and (d) and adding Subsections
1818 (a-1), (c-1), (e), and (f) to read as follows:
1919 (a) A person commits an offense if the person:
2020 (1) sells, rents, leases, loans, or gives a firearm
2121 [handgun] to any person knowing that the person to whom the firearm
2222 [handgun] is to be delivered intends to use the firearm [it]
2323 unlawfully or in the commission of an unlawful act; or
2424 (2) purchases or attempts to purchase a firearm with
2525 intent to deliver the firearm to a person knowing that the person to
2626 whom the firearm is to be delivered intends to possess the firearm
2727 unlawfully or to use the firearm unlawfully or in the commission of
2828 an unlawful act.
2929 (a-1) A person commits an offense if the person:
3030 (1) [(2)] intentionally or knowingly sells, rents,
3131 leases, or gives or offers to sell, rent, lease, or give to any
3232 child younger than 18 years of age any firearm, club, or
3333 location-restricted knife;
3434 (2) [(3)] intentionally, knowingly, or recklessly
3535 sells a firearm or ammunition for a firearm to any person who is
3636 intoxicated;
3737 (3) [(4)] knowingly sells a firearm or ammunition for
3838 a firearm to any person who has been convicted of a felony before
3939 the fifth anniversary of the later of the following dates:
4040 (A) the person's release from confinement
4141 following conviction of the felony; or
4242 (B) the person's release from supervision under
4343 community supervision, parole, or mandatory supervision following
4444 conviction of the felony;
4545 (4) [(5)] sells, rents, leases, loans, or gives a
4646 handgun to any person knowing that an active protective order is
4747 directed to the person to whom the handgun is to be delivered;
4848 (5) [(6)] knowingly purchases, rents, leases, or
4949 receives as a loan or gift from another a handgun while an active
5050 protective order is directed to the actor; or
5151 (6) [(7)] while prohibited from possessing a firearm
5252 under state or federal law, knowingly makes a material false
5353 statement on a form that is:
5454 (A) required by state or federal law for the
5555 purchase, sale, or other transfer of a firearm; and
5656 (B) submitted to a [licensed] firearms dealer
5757 licensed under [, as defined by] 18 U.S.C. Section 923.
5858 (c) It is an affirmative defense to prosecution under
5959 Subsection (a-1)(1) [(a)(2)] that the transfer was to a minor whose
6060 parent or the person having legal custody of the minor had given
6161 written permission for the sale or, if the transfer was other than a
6262 sale, the parent or person having legal custody had given effective
6363 consent.
6464 (c-1) The renunciation defense described by Section
6565 15.04(a) is available as an affirmative defense to prosecution of
6666 an attempted purchase under Subsection (a)(2).
6767 (d) An offense under Subsection (a) is a felony of the third
6868 degree.
6969 (e) An offense under Subsection (a-1) [this section] is a
7070 Class A misdemeanor, except that:
7171 (1) an offense under Subsection (a-1)(1) [(a)(2)] is a
7272 state jail felony if the weapon that is the subject of the offense
7373 is a handgun; and
7474 (2) an offense under Subsection (a-1)(6) [(a)(7)] is a
7575 state jail felony.
7676 (f) To the extent of any conflict between this section and a
7777 federal law related to the unlawful transfer or purchase of
7878 weapons, the federal law prevails.
7979 SECTION 3. Article 59.01(2), Code of Criminal Procedure, is
8080 amended to read as follows:
8181 (2) "Contraband" means property of any nature,
8282 including real, personal, tangible, or intangible, that is:
8383 (A) used in the commission of:
8484 (i) any first or second degree felony under
8585 the Penal Code;
8686 (ii) any felony under Section 15.031(b),
8787 21.11, or 38.04 or Chapter 29, 30, 31, 32, 33, 33A, or 35, Penal
8888 Code;
8989 (iii) any felony under Chapter 43, Penal
9090 Code, except as provided by Paragraph (B);
9191 (iv) any felony under The Securities Act
9292 (Title 12, Government Code); or
9393 (v) any offense under Chapter 49, Penal
9494 Code, that is punishable as a felony of the third degree or state
9595 jail felony, if the defendant has been previously convicted three
9696 times of an offense under that chapter;
9797 (B) used or intended to be used in the commission
9898 of:
9999 (i) any felony under Chapter 481, Health
100100 and Safety Code (Texas Controlled Substances Act);
101101 (ii) any felony under Chapter 483, Health
102102 and Safety Code;
103103 (iii) a felony under Chapter 151, Finance
104104 Code;
105105 (iv) any felony under Chapter 20A or 34,
106106 Penal Code;
107107 (v) a Class A misdemeanor under Subchapter
108108 B, Chapter 365, Health and Safety Code, if the defendant has been
109109 previously convicted twice of an offense under that subchapter;
110110 (vi) any felony under Chapter 32, Human
111111 Resources Code, or Chapter 31, 32, 35A, or 37, Penal Code, that
112112 involves a health care program, as defined by Section 35A.01, Penal
113113 Code;
114114 (vii) a Class B misdemeanor under Chapter
115115 522, Business & Commerce Code;
116116 (viii) a Class A misdemeanor under Section
117117 306.051, Business & Commerce Code;
118118 (ix) any offense under Section 42.10, Penal
119119 Code;
120120 (x) any offense under Section 46.06(a)
121121 [46.06(a)(1)] or 46.14, Penal Code;
122122 (xi) any offense under Chapter 71, Penal
123123 Code;
124124 (xii) any offense under Section 20.05,
125125 20.06, 20.07, 43.04, or 43.05, Penal Code;
126126 (xiii) an offense under Section 326.002,
127127 Business & Commerce Code; or
128128 (xiv) a Class A misdemeanor or any felony
129129 under Section 545.420, Transportation Code, other than a Class A
130130 misdemeanor that is classified as a Class A misdemeanor based
131131 solely on conduct constituting a violation of Subsection (e)(2)(B)
132132 of that section;
133133 (C) the proceeds gained from the commission of a
134134 felony listed in Paragraph (A) or (B) of this subdivision, a
135135 misdemeanor listed in Paragraph (B)(vii), (ix), (x), (xi), or (xii)
136136 of this subdivision, or a crime of violence;
137137 (D) acquired with proceeds gained from the
138138 commission of a felony listed in Paragraph (A) or (B) of this
139139 subdivision, a misdemeanor listed in Paragraph (B)(vii), (ix), (x),
140140 (xi), or (xii) of this subdivision, or a crime of violence;
141141 (E) used to facilitate or intended to be used to
142142 facilitate the commission of a felony under Section 15.031 or
143143 Chapter 43, Penal Code; or
144144 (F) used to facilitate or intended to be used to
145145 facilitate the commission of an offense under Section 20.05, 20.06,
146146 or 20.07 or Chapter 20A, Penal Code.
147147 SECTION 4. Section 71.02(a), Penal Code, is amended to read
148148 as follows:
149149 (a) A person commits an offense if, with the intent to
150150 establish, maintain, or participate in a combination or in the
151151 profits of a combination or as a member of a criminal street gang,
152152 the person commits or conspires to commit one or more of the
153153 following:
154154 (1) murder, capital murder, arson, aggravated
155155 robbery, robbery, burglary, theft, aggravated kidnapping,
156156 kidnapping, aggravated assault, aggravated sexual assault, sexual
157157 assault, continuous sexual abuse of young child or disabled
158158 individual, solicitation of a minor, forgery, deadly conduct,
159159 assault punishable as a Class A misdemeanor, burglary of a motor
160160 vehicle, or unauthorized use of a motor vehicle;
161161 (2) any gambling offense punishable as a Class A
162162 misdemeanor;
163163 (3) promotion of prostitution, aggravated promotion
164164 of prostitution, or compelling prostitution;
165165 (4) unlawful manufacture, transportation, repair, or
166166 sale of firearms or prohibited weapons;
167167 (5) unlawful manufacture, delivery, dispensation, or
168168 distribution of a controlled substance or dangerous drug, or
169169 unlawful possession of a controlled substance or dangerous drug
170170 through forgery, fraud, misrepresentation, or deception;
171171 (5-a) causing the unlawful delivery, dispensation, or
172172 distribution of a controlled substance or dangerous drug in
173173 violation of Subtitle B, Title 3, Occupations Code;
174174 (6) any unlawful wholesale promotion or possession of
175175 any obscene material or obscene device with the intent to wholesale
176176 promote the same;
177177 (7) any offense under Subchapter B, Chapter 43,
178178 depicting or involving conduct by or directed toward a child
179179 younger than 18 years of age;
180180 (8) any felony offense under Chapter 32;
181181 (9) any offense under Chapter 36;
182182 (10) any offense under Chapter 34, 35, or 35A;
183183 (11) any offense under Section 37.11(a);
184184 (12) any offense under Chapter 20A;
185185 (13) any offense under Section 37.10;
186186 (14) any offense under Section 38.06, 38.07, 38.09, or
187187 38.11;
188188 (15) any offense under Section 42.10;
189189 (16) any offense under Section 46.06(a) [46.06(a)(1)]
190190 or 46.14;
191191 (17) any offense under Section 20.05 or 20.06;
192192 (18) any offense under Section 16.02; or
193193 (19) any offense classified as a felony under the Tax
194194 Code.
195195 SECTION 5. The change in law made by this Act applies only
196196 to an offense committed on or after the effective date of this Act.
197197 An offense committed before the effective date of this Act is
198198 governed by the law in effect on the date the offense was committed,
199199 and the former law is continued in effect for that purpose. For
200200 purposes of this section, an offense was committed before the
201201 effective date of this Act if any element of the offense occurred
202202 before that date.
203203 SECTION 6. This Act takes effect September 1, 2025.
