| 10 | 10 | | subcontractors of contract carriers. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 644.054, Transportation Code, is amended |
|---|
| 13 | 13 | | by amending Subsections (a) and (b) and adding Subsection (a-1) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (a) In this section, "contract carrier" includes a |
|---|
| 16 | 16 | | subcontractor of a contract carrier. |
|---|
| 17 | 17 | | (a-1) This section applies only to a contract carrier that |
|---|
| 18 | 18 | | transports an operating employee of a railroad on a road or highway |
|---|
| 19 | 19 | | of this state in a vehicle designed to carry 15 or fewer passengers. |
|---|
| 20 | 20 | | (b) The department shall adopt rules regulating the |
|---|
| 21 | 21 | | operation of a contract carrier to which this section applies. The |
|---|
| 22 | 22 | | rules must: |
|---|
| 23 | 23 | | (1) prohibit a person from operating a vehicle for |
|---|
| 24 | 24 | | more than 12 hours in a day; |
|---|
| 25 | 25 | | (2) require a person who operates a vehicle for the |
|---|
| 26 | 26 | | number of consecutive hours or days the department determines is |
|---|
| 27 | 27 | | excessive to rest for a period determined by the department; |
|---|
| 28 | 28 | | (3) require a contract carrier to keep a record of all |
|---|
| 29 | 29 | | hours a vehicle subject to regulation under this section is |
|---|
| 30 | 30 | | operated; |
|---|
| 31 | 31 | | (4) require a contract carrier to perform alcohol and |
|---|
| 32 | 32 | | drug testing of vehicle operators on employment, on suspicion of |
|---|
| 33 | 33 | | alcohol or drug abuse, and periodically as determined by the |
|---|
| 34 | 34 | | department; |
|---|
| 35 | 35 | | (5) require a contract carrier, at a minimum, to |
|---|
| 36 | 36 | | maintain commercial automobile liability insurance in the amount of |
|---|
| 37 | 37 | | $1.5 million for each vehicle; and |
|---|
| 38 | 38 | | (6) be determined by the department to be necessary to |
|---|
| 39 | 39 | | protect the safety of a passenger being transported or the general |
|---|
| 40 | 40 | | public. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2025. |
