77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation of certain contract carriers and
1010 subcontractors of contract carriers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 644.054, Transportation Code, is amended
1313 by amending Subsections (a) and (b) and adding Subsection (a-1) to
1414 read as follows:
1515 (a) In this section, "contract carrier" includes a
1616 subcontractor of a contract carrier.
1717 (a-1) This section applies only to a contract carrier that
1818 transports an operating employee of a railroad on a road or highway
1919 of this state in a vehicle designed to carry 15 or fewer passengers.
2020 (b) The department shall adopt rules regulating the
2121 operation of a contract carrier to which this section applies. The
2222 rules must:
2323 (1) prohibit a person from operating a vehicle for
2424 more than 12 hours in a day;
2525 (2) require a person who operates a vehicle for the
2626 number of consecutive hours or days the department determines is
2727 excessive to rest for a period determined by the department;
2828 (3) require a contract carrier to keep a record of all
2929 hours a vehicle subject to regulation under this section is
3030 operated;
3131 (4) require a contract carrier to perform alcohol and
3232 drug testing of vehicle operators on employment, on suspicion of
3333 alcohol or drug abuse, and periodically as determined by the
3434 department;
3535 (5) require a contract carrier, at a minimum, to
3636 maintain commercial automobile liability insurance in the amount of
3737 $1.5 million for each vehicle; and
3838 (6) be determined by the department to be necessary to
3939 protect the safety of a passenger being transported or the general
4040 public.
4141 SECTION 2. This Act takes effect September 1, 2025.
