77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a school district student's reentry into a regular
1010 educational environment from an alternative education program,
1111 including parental rights related to that reentry.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 37.008(a-1), Education Code, is amended
1414 to read as follows:
1515 (a-1) The agency shall adopt minimum standards for the
1616 operation of disciplinary alternative education programs,
1717 including standards relating to:
1818 (1) student/teacher ratios;
1919 (2) student health and safety;
2020 (3) reporting of abuse, neglect, or exploitation of
2121 students;
2222 (4) training for teachers in behavior management and
2323 safety procedures; and
2424 (5) planning for a student's reentry into a regular
2525 educational environment [transition] from a disciplinary
2626 alternative education program [to a regular campus].
2727 SECTION 2. The heading to Section 37.023, Education Code,
2828 is amended to read as follows:
2929 Sec. 37.023. REENTRY INTO REGULAR EDUCATIONAL ENVIRONMENT
3030 [TRANSITION] FROM ALTERNATIVE EDUCATION PROGRAM [TO REGULAR
3131 CLASSROOM].
3232 SECTION 3. Section 37.023, Education Code, is amended by
3333 amending Subsections (c), (d), and (e) and adding Subsections (c-1)
3434 and (g) to read as follows:
3535 (c) Not later than five instructional days after the date of
3636 a student's release from an alternative education program, the
3737 campus administrator shall hold a meeting to coordinate the
3838 student's enrollment and reentry into [transition to] a regular
3939 educational environment [classroom]. The coordination must
4040 include assistance and recommendations from the student's parent or
4141 a person standing in parental relation to the student and, as
4242 applicable:
4343 (1) school counselors;
4444 (2) school district peace officers;
4545 (3) school resource officers;
4646 (4) licensed clinical social workers;
4747 (5) campus behavior coordinators;
4848 (6) classroom teachers who are or may be responsible
4949 for implementing the student's personalized school reentry
5050 [transition] plan developed under Subsection (d); and
5151 (7) any other appropriate school district personnel.
5252 (c-1) The campus administrator shall, before finalizing a
5353 personalized school reentry plan for a student under Subsection
5454 (d), provide to the student's parent or a person standing in
5555 parental relation to the student:
5656 (1) a list of the people who will be assisting in the
5757 student's reentry into a regular educational environment under
5858 Subsection (c); and
5959 (2) an opportunity to meet, either in person or
6060 remotely, with the people included on the list described by
6161 Subdivision (1) to:
6262 (A) discuss any proposed assistance or
6363 recommendations for the student's reentry; and
6464 (B) provide information regarding the student
6565 that may be useful in developing the plan.
6666 (d) The enrollment and school reentry assistance required
6767 by Subsection (c) must include a personalized school reentry
6868 [transition] plan for the student developed by the campus
6969 administrator. A personalized school reentry [transition] plan:
7070 (1) must include:
7171 (A) recommendations for the best educational
7272 placement of the student; and
7373 (B) the provision of information to the student's
7474 parent or a person standing in parental relation to the student
7575 regarding the process to request a full individual and initial
7676 evaluation of the student for purposes of special education
7777 services under Section 29.004; and
7878 (2) may include:
7979 (A) recommendations for counseling, behavioral
8080 management, or academic assistance for the student with a
8181 concentration on the student's academic or career goals;
8282 (B) recommendations for assistance for obtaining
8383 access to mental health services provided by the district or
8484 school, a local mental health authority, or another private or
8585 public entity; and
8686 (C) a regular review of the student's progress
8787 toward the student's academic or career goals.
8888 (e) As soon as practicable after completing a student's
8989 personalized school reentry plan under Subsection (d) [If
9090 practicable], the campus administrator shall provide an electronic
9191 or written copy of the plan to [, or the administrator's designee,
9292 shall meet with] the student's parent or a person standing in
9393 parental relation to the student [to coordinate plans for the
9494 student's transition].
9595 (g) The commissioner may adopt rules as necessary to
9696 implement this section.
9797 SECTION 4. This Act applies beginning with the 2025-2026
9898 school year.
9999 SECTION 5. This Act takes effect immediately if it receives
100100 a vote of two-thirds of all the members elected to each house, as
101101 provided by Section 39, Article III, Texas Constitution. If this
102102 Act does not receive the vote necessary for immediate effect, this
103103 Act takes effect September 1, 2025.
