| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 56, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 56.010 to read as follows: |
|---|
| 15 | 15 | | Sec. 56.010. CONSIDERATION OF CERTAIN FACTORS REGARDING |
|---|
| 16 | 16 | | STUDENT FINANCIAL ASSISTANCE PROHIBITED. Notwithstanding any |
|---|
| 17 | 17 | | other provision of this code, an institution of higher education |
|---|
| 18 | 18 | | may not: |
|---|
| 19 | 19 | | (1) award student financial assistance based on race, |
|---|
| 20 | 20 | | sex, gender, or sexual orientation; or |
|---|
| 21 | 21 | | (2) pay for or advertise student financial assistance |
|---|
| 22 | 22 | | awarded based on race, sex, gender, or sexual orientation. |

| 23 | 23 | | SECTION 2. Section 56.010, Education Code, as added by this |
|---|
| 24 | 24 | | Act, applies beginning with student financial assistance paid for, |
|---|
| 25 | 25 | | advertised, or awarded by a public institution of higher education |
|---|
| 26 | 26 | | for the 2026 fall semester. Student financial assistance paid for, |
|---|
| 27 | 27 | | advertised, or awarded for a term or semester before the 2026 fall |
|---|
| 28 | 28 | | semester is governed by the law in effect on the date on which the |
|---|
| 29 | 29 | | student financial assistance was paid for, advertised, or awarded, |
|---|
| 30 | 30 | | and the former law is continued in effect for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2025. |
