66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to emergency services requirements for certain plots or
99 tracts of land in the unincorporated area of certain counties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 232, Local Government
1212 Code, is amended by adding Section 232.0035 to read as follows:
1313 Sec. 232.0035. ADDITIONAL REQUIREMENTS: EMERGENCY SERVICES
1414 FOR CERTAIN AREAS IN CERTAIN COUNTIES. (a) This section applies
1515 only to a plot or tract of land with at least four residential
1616 dwelling units per acre or at least 50 dwelling units that is wholly
1717 located in the unincorporated area of a county with a population of
1818 400,000 or less.
1919 (b) Notwithstanding Section 232.007, this section applies
2020 to a plot or tract of land subject to this section located in a
2121 manufactured home community.
2222 (c) In addition to any other requirement under law, the
2323 commissioners court of a county may by order require that a plot or
2424 tract of land subject to this section:
2525 (1) contain a number of fire hydrants sufficient to
2626 protect the dwellings in the plot or tract from fire;
2727 (2) have at least two means of both ingress and egress
2828 to provide for sufficient routes of travel for use by emergency
2929 vehicles and for use during evacuations resulting from fire or
3030 other natural disasters; and
3131 (3) be located not more than 10 miles from an emergency
3232 services district.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2025.
