77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to authorizing certain counties to impose a hotel
1010 occupancy tax and the use of revenue from that tax.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 352.002, Tax Code, is amended by adding
1313 Subsection (jj) to read as follows:
1414 (jj) The commissioners court of a county that has a
1515 population of more than 125,000, borders the Red River, and has a
1616 county seat with a population of more than 100,000 may impose a tax
1717 as provided by Subsection (a). This subsection expires September
1818 1, 2030.
1919 SECTION 2. Section 352.003, Tax Code, is amended by adding
2020 Subsection (ff) to read as follows:
2121 (ff) The tax rate in a county authorized to impose the tax
2222 under Section 352.002(jj) may not exceed two percent of the price
2323 paid for a room in a hotel. This subsection expires September 1,
2424 2030.
2525 SECTION 3. Subchapter B, Chapter 352, Tax Code, is amended
2626 by adding Section 352.118 to read as follows:
2727 Sec. 352.118. USE OF REVENUE: CERTAIN COUNTIES BORDERING
2828 THE RED RIVER. (a) In addition to the purposes authorized by this
2929 chapter, the revenue from a tax imposed under this chapter by a
3030 county authorized to impose the tax under Section 352.002(jj) may
3131 be used for:
3232 (1) expenses, including promotion expenses, directly
3333 related to a sporting event in which some of the participants are
3434 tourists who increase economic activity at hotels and motels within
3535 the county;
3636 (2) construction, improvement, operation, and
3737 maintenance of an amphitheater, park, or other similar public space
3838 that serves to promote the arts and attract visitors and tourists to
3939 the county;
4040 (3) providing grants to art and cultural organizations
4141 in the county that develop and promote events that attract visitors
4242 and tourists to the county;
4343 (4) funding local history museums that attract
4444 tourists, including funding the expansion of offerings and
4545 exhibits; and
4646 (5) the hiring of one or more staff to manage the
4747 efficient administration of the revenue from the tax, provided that
4848 no more than 10 percent of the revenue is used for this purpose.
4949 (b) This section expires September 1, 2030.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2025.
