| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 54.213, Education Code, is amended by |
|---|
| 14 | 14 | | amending Subsection (b) and adding Subsection (c) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (b) The total number of students at an institution paying |
|---|
| 17 | 17 | | resident tuition under this section for a particular semester may |
|---|
| 18 | 18 | | not exceed: |
|---|
| 19 | 19 | | (1) five percent of the total number of students |
|---|
| 20 | 20 | | registered at the institution for the same semester of the |
|---|
| 21 | 21 | | preceding academic year if the institution is not an institution to |
|---|
| 22 | 22 | | which Subdivision (2) applies; or |
|---|
| 23 | 23 | | (2) 20 percent of the total number of students |
|---|
| 24 | 24 | | registered at the institution for the same semester of the |
|---|
| 25 | 25 | | preceding academic year if as determined by Texas Higher Education |
|---|
| 26 | 26 | | Coordinating Board rule: |
|---|
| 27 | 27 | | (A) the institution is located in a region that |
|---|
| 28 | 28 | | is experiencing a population growth rate less than the statewide |
|---|
| 29 | 29 | | average based on the most recent available data; and |
|---|
| 30 | 30 | | (B) the most recent space usage efficiency report |
|---|
| 31 | 31 | | prepared by the coordinating board indicates the institution has |
|---|
| 32 | 32 | | sufficient capacity to support the nonresident students. |
|---|
| 33 | 33 | | (c) The coordinating board shall adopt rules as necessary to |
|---|
| 34 | 34 | | implement this section. |
|---|
| 35 | 35 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 36 | 36 | | 54.213, Education Code, applies beginning with the 2025-2026 |
|---|
| 37 | 37 | | academic year. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2025. |
