77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the maximum number of nonresident scholarship students
1010 permitted to pay resident tuition and fees at certain public
1111 institutions of higher education.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 54.213, Education Code, is amended by
1414 amending Subsection (b) and adding Subsection (c) to read as
1515 follows:
1616 (b) The total number of students at an institution paying
1717 resident tuition under this section for a particular semester may
1818 not exceed:
1919 (1) five percent of the total number of students
2020 registered at the institution for the same semester of the
2121 preceding academic year if the institution is not an institution to
2222 which Subdivision (2) applies; or
2323 (2) 20 percent of the total number of students
2424 registered at the institution for the same semester of the
2525 preceding academic year if as determined by Texas Higher Education
2626 Coordinating Board rule:
2727 (A) the institution is located in a region that
2828 is experiencing a population growth rate less than the statewide
2929 average based on the most recent available data; and
3030 (B) the most recent space usage efficiency report
3131 prepared by the coordinating board indicates the institution has
3232 sufficient capacity to support the nonresident students.
3333 (c) The coordinating board shall adopt rules as necessary to
3434 implement this section.
3535 SECTION 2. The change in law made by this Act to Section
3636 54.213, Education Code, applies beginning with the 2025-2026
3737 academic year.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2025.
