77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the filing of a campaign treasurer appointment and an
1010 application for a place on the ballot by a candidate for the board
1111 of directors of an appraisal district.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 252.005, Election Code, is amended to
1414 read as follows:
1515 Sec. 252.005. AUTHORITY WITH WHOM APPOINTMENT FILED:
1616 CANDIDATE. An individual must file a campaign treasurer
1717 appointment for the individual's own candidacy with:
1818 (1) the commission, if the appointment is made for
1919 candidacy for:
2020 (A) a statewide office;
2121 (B) a district office filled by voters of more
2222 than one county;
2323 (C) a judicial district office filled by voters
2424 of only one county;
2525 (D) state senator;
2626 (E) state representative; or
2727 (F) the State Board of Education;
2828 (2) the county clerk, if the appointment is made for
2929 candidacy for:
3030 (A) a county office; [,]
3131 (B) a precinct office; [,]
3232 (C) an elected position on the board of directors
3333 of an appraisal district to which Section 6.0301, Tax Code,
3434 applies; or
3535 (D) a district office other than one included in
3636 Subdivision (1);
3737 (3) except as otherwise provided by this section, the
3838 clerk or secretary of the governing body of the political
3939 subdivision or, if the political subdivision has no clerk or
4040 secretary, with the governing body's presiding officer, if the
4141 appointment is made for candidacy for an office of a political
4242 subdivision other than a county;
4343 (4) the county clerk if:
4444 (A) the appointment is made for candidacy for an
4545 office of a political subdivision other than a county;
4646 (B) the governing body for the political
4747 subdivision has not been formed; and
4848 (C) no boundary of the political subdivision
4949 crosses a boundary of the county; or
5050 (5) the commission if:
5151 (A) the appointment is made for candidacy for an
5252 office of a political subdivision other than a county;
5353 (B) the governing body for the political
5454 subdivision has not been formed; and
5555 (C) the political subdivision is situated in more
5656 than one county.
5757 SECTION 2. Section 6.032(b), Tax Code, is amended to read as
5858 follows:
5959 (b) An application for a place on the ballot must be filed
6060 with the county clerk [judge] of the county in which the appraisal
6161 district is established and be accompanied by a filing fee
6262 prescribed by Subsection (c) of this section or a petition in lieu
6363 of the filing fee that satisfies the requirements prescribed by
6464 Section 141.062, Election Code, and Subsection (d) of this section.
6565 SECTION 3. Section 252.005, Election Code, as amended by
6666 this Act, applies only to a campaign treasurer appointment required
6767 to be filed under Chapter 252, Election Code, on or after the
6868 effective date of this Act. A campaign treasurer appointment
6969 required to be filed before the effective date of this Act is
7070 governed by the law in effect on the date the appointment was filed,
7171 and the former law is continued in effect for that purpose.
7272 SECTION 4. Section 6.032, Tax Code, as amended by this Act,
7373 applies only to an application for a place on the ballot for a
7474 position on the board of directors of an appraisal district
7575 required to be filed on or after the effective date of this Act. An
7676 application required to be filed before the effective date of this
7777 Act is governed by the law in effect on the date the application was
7878 filed, and the former law is continued in effect for that purpose.
7979 SECTION 5. This Act takes effect September 1, 2025.
