77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting contracts between certain state agencies
1010 and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle F, Title 10, Government Code, is
1313 amended by adding Chapter 2278 to read as follows:
1414 CHAPTER 2278. PROHIBITED CONTRACTS WITH CERTAIN FEDERAL AGENCIES
1515 Sec. 2278.001. DEFINITION. In this chapter, "state agency"
1616 means:
1717 (1) a board, commission, department, office, or other
1818 agency in the executive branch of state government that is created
1919 by the constitution or a statute of this state, including a river
2020 authority and an institution of higher education as defined by
2121 Section 61.003, Education Code;
2222 (2) the legislature or a legislative agency; or
2323 (3) the Supreme Court of Texas, the Court of Criminal
2424 Appeals of Texas, a court of appeals, a state judicial agency, or
2525 the State Bar of Texas.
2626 Sec. 2278.002. CONTRACTS WITH BUREAU OF ALCOHOL, TOBACCO,
2727 FIREARMS AND EXPLOSIVES PROHIBITED. A state agency may not enter
2828 into a contract with the Bureau of Alcohol, Tobacco, Firearms and
2929 Explosives of the United States Department of Justice.
3030 SECTION 2. Chapter 2278, Government Code, as added by this
3131 Act, applies only to a contract entered into on or after the
3232 effective date of this Act. A contract entered into before that
3333 date is governed by the law in effect on the date the contract was
3434 entered into, and the former law is continued in effect for that
3535 purpose.
3636 SECTION 3. This Act takes effect September 1, 2025.
