77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the licensing of real estate inspectors.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1102.001(5), Occupations Code, is
1212 redesignated as Section 1102.001(8-a), Occupations Code, and
1313 amended to read as follows:
1414 (8-a) "Qualifying [(5) "Core] real estate inspection
1515 course" means an educational course approved by the commission that
1616 relates to real estate inspection, including a course on structural
1717 items, electrical items, mechanical systems, plumbing systems,
1818 roofing, business, law, standards of practice, report writing,
1919 appliances, or ethics.
2020 SECTION 2. Section 1102.107, Occupations Code, is amended
2121 to read as follows:
2222 Sec. 1102.107. ELIGIBILITY FOR APPRENTICE INSPECTOR
2323 LICENSE. To be eligible for an apprentice inspector license, an
2424 applicant must:
2525 (1) at the time of application be:
2626 (A) at least 18 years of age; and
2727 (B) a citizen of the United States or a lawfully
2828 admitted alien;
2929 (2) be sponsored by a professional inspector; [and]
3030 (3) submit evidence satisfactory to the commission of
3131 successful completion of at least four classroom hours of a
3232 qualifying real estate inspection course as required by commission
3333 rule; and
3434 (4) satisfy the commission as to the applicant's
3535 honesty, trustworthiness, and integrity.
3636 SECTION 3. Section 1102.108(a), Occupations Code, is
3737 amended to read as follows:
3838 (a) To be eligible for a real estate inspector license, an
3939 applicant must:
4040 (1) at the time of application have:
4141 (A) held an apprentice inspector license for at
4242 least three months; and
4343 (B) performed at least 25 real estate inspections
4444 under direct supervision;
4545 (2) submit evidence satisfactory to the commission of
4646 successful completion of at least 90 classroom hours of qualifying
4747 [core] real estate inspection courses, in addition to the hours
4848 required by Section 1102.107;
4949 (3) demonstrate competence based on the examination
5050 under Subchapter D;
5151 (4) be sponsored by a professional inspector; and
5252 (5) satisfy the commission as to the applicant's
5353 honesty, trustworthiness, integrity, and competence.
5454 SECTION 4. Section 1102.109, Occupations Code, is amended
5555 to read as follows:
5656 Sec. 1102.109. ELIGIBILITY FOR PROFESSIONAL INSPECTOR
5757 LICENSE. To be eligible for a professional inspector license, an
5858 applicant must:
5959 (1) at the time of application have:
6060 (A) held a real estate inspector license for at
6161 least 12 months; and
6262 (B) performed at least 175 real estate
6363 inspections under indirect supervision;
6464 (2) submit evidence satisfactory to the commission of
6565 successful completion of at least 40 classroom hours of qualifying
6666 [core] real estate inspection courses, in addition to the hours
6767 required by Sections 1102.107 and [Section] 1102.108;
6868 (3) demonstrate competence based on the examination
6969 under Subchapter D; and
7070 (4) satisfy the commission as to the applicant's
7171 honesty, trustworthiness, integrity, and competence.
7272 SECTION 5. Section 1102.111(b), Occupations Code, is
7373 amended to read as follows:
7474 (b) Rules adopted under Subsection (a) may not require an
7575 applicant to:
7676 (1) complete more than 320 additional hours of
7777 qualifying [core] real estate inspection courses;
7878 (2) complete more than 40 hours of field work, if the
7979 applicant completes correspondence or other course provided by
8080 alternative means; or
8181 (3) have more than seven years of relevant experience.
8282 SECTION 6. Section 1102.151(a), Occupations Code, is
8383 amended to read as follows:
8484 (a) A license examination must evaluate competence in the
8585 subject matter of each required qualifying [core] real estate
8686 inspection course.
8787 SECTION 7. Section 1102.205(b), Occupations Code, is
8888 amended to read as follows:
8989 (b) As a prerequisite for renewal of a real estate inspector
9090 license, professional inspector license, or apprentice inspector
9191 license, the inspector must participate in the continuing education
9292 program and submit evidence satisfactory to the commission of
9393 successful completion of at least 16 classroom hours of qualifying
9494 [core] real estate inspection courses or continuing education
9595 courses for each year of the license period preceding the renewal.
9696 SECTION 8. Sections 1102.107, 1102.108(a), and 1102.109,
9797 Occupations Code, as amended by this Act, apply only to an
9898 application for a license under Chapter 1102, Occupations Code,
9999 submitted on or after the effective date of this Act. An
100100 application for a license submitted before the effective date of
101101 this Act is governed by the law in effect on the date the
102102 application was submitted, and the former law is continued in
103103 effect for that purpose.
104104 SECTION 9. This Act takes effect January 1, 2026.
