9 | 9 | | relating to the licensing of real estate inspectors. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 1102.001(5), Occupations Code, is |
---|
12 | 12 | | redesignated as Section 1102.001(8-a), Occupations Code, and |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (8-a) "Qualifying [(5) "Core] real estate inspection |
---|
15 | 15 | | course" means an educational course approved by the commission that |
---|
16 | 16 | | relates to real estate inspection, including a course on structural |
---|
17 | 17 | | items, electrical items, mechanical systems, plumbing systems, |
---|
18 | 18 | | roofing, business, law, standards of practice, report writing, |
---|
19 | 19 | | appliances, or ethics. |
---|
20 | 20 | | SECTION 2. Section 1102.107, Occupations Code, is amended |
---|
21 | 21 | | to read as follows: |
---|
22 | 22 | | Sec. 1102.107. ELIGIBILITY FOR APPRENTICE INSPECTOR |
---|
23 | 23 | | LICENSE. To be eligible for an apprentice inspector license, an |
---|
24 | 24 | | applicant must: |
---|
25 | 25 | | (1) at the time of application be: |
---|
26 | 26 | | (A) at least 18 years of age; and |
---|
27 | 27 | | (B) a citizen of the United States or a lawfully |
---|
28 | 28 | | admitted alien; |
---|
29 | 29 | | (2) be sponsored by a professional inspector; [and] |
---|
30 | 30 | | (3) submit evidence satisfactory to the commission of |
---|
31 | 31 | | successful completion of at least four classroom hours of a |
---|
32 | 32 | | qualifying real estate inspection course as required by commission |
---|
33 | 33 | | rule; and |
---|
34 | 34 | | (4) satisfy the commission as to the applicant's |
---|
35 | 35 | | honesty, trustworthiness, and integrity. |
---|
36 | 36 | | SECTION 3. Section 1102.108(a), Occupations Code, is |
---|
37 | 37 | | amended to read as follows: |
---|
38 | 38 | | (a) To be eligible for a real estate inspector license, an |
---|
39 | 39 | | applicant must: |
---|
40 | 40 | | (1) at the time of application have: |
---|
41 | 41 | | (A) held an apprentice inspector license for at |
---|
42 | 42 | | least three months; and |
---|
43 | 43 | | (B) performed at least 25 real estate inspections |
---|
44 | 44 | | under direct supervision; |
---|
45 | 45 | | (2) submit evidence satisfactory to the commission of |
---|
46 | 46 | | successful completion of at least 90 classroom hours of qualifying |
---|
47 | 47 | | [core] real estate inspection courses, in addition to the hours |
---|
48 | 48 | | required by Section 1102.107; |
---|
49 | 49 | | (3) demonstrate competence based on the examination |
---|
50 | 50 | | under Subchapter D; |
---|
51 | 51 | | (4) be sponsored by a professional inspector; and |
---|
52 | 52 | | (5) satisfy the commission as to the applicant's |
---|
53 | 53 | | honesty, trustworthiness, integrity, and competence. |
---|
54 | 54 | | SECTION 4. Section 1102.109, Occupations Code, is amended |
---|
55 | 55 | | to read as follows: |
---|
56 | 56 | | Sec. 1102.109. ELIGIBILITY FOR PROFESSIONAL INSPECTOR |
---|
57 | 57 | | LICENSE. To be eligible for a professional inspector license, an |
---|
58 | 58 | | applicant must: |
---|
59 | 59 | | (1) at the time of application have: |
---|
60 | 60 | | (A) held a real estate inspector license for at |
---|
61 | 61 | | least 12 months; and |
---|
62 | 62 | | (B) performed at least 175 real estate |
---|
63 | 63 | | inspections under indirect supervision; |
---|
64 | 64 | | (2) submit evidence satisfactory to the commission of |
---|
65 | 65 | | successful completion of at least 40 classroom hours of qualifying |
---|
66 | 66 | | [core] real estate inspection courses, in addition to the hours |
---|
67 | 67 | | required by Sections 1102.107 and [Section] 1102.108; |
---|
68 | 68 | | (3) demonstrate competence based on the examination |
---|
69 | 69 | | under Subchapter D; and |
---|
70 | 70 | | (4) satisfy the commission as to the applicant's |
---|
71 | 71 | | honesty, trustworthiness, integrity, and competence. |
---|
72 | 72 | | SECTION 5. Section 1102.111(b), Occupations Code, is |
---|
73 | 73 | | amended to read as follows: |
---|
74 | 74 | | (b) Rules adopted under Subsection (a) may not require an |
---|
75 | 75 | | applicant to: |
---|
76 | 76 | | (1) complete more than 320 additional hours of |
---|
77 | 77 | | qualifying [core] real estate inspection courses; |
---|
78 | 78 | | (2) complete more than 40 hours of field work, if the |
---|
79 | 79 | | applicant completes correspondence or other course provided by |
---|
80 | 80 | | alternative means; or |
---|
81 | 81 | | (3) have more than seven years of relevant experience. |
---|
82 | 82 | | SECTION 6. Section 1102.151(a), Occupations Code, is |
---|
83 | 83 | | amended to read as follows: |
---|
84 | 84 | | (a) A license examination must evaluate competence in the |
---|
85 | 85 | | subject matter of each required qualifying [core] real estate |
---|
86 | 86 | | inspection course. |
---|
87 | 87 | | SECTION 7. Section 1102.205(b), Occupations Code, is |
---|
88 | 88 | | amended to read as follows: |
---|
89 | 89 | | (b) As a prerequisite for renewal of a real estate inspector |
---|
90 | 90 | | license, professional inspector license, or apprentice inspector |
---|
91 | 91 | | license, the inspector must participate in the continuing education |
---|
92 | 92 | | program and submit evidence satisfactory to the commission of |
---|
93 | 93 | | successful completion of at least 16 classroom hours of qualifying |
---|
94 | 94 | | [core] real estate inspection courses or continuing education |
---|
95 | 95 | | courses for each year of the license period preceding the renewal. |
---|
96 | 96 | | SECTION 8. Sections 1102.107, 1102.108(a), and 1102.109, |
---|
97 | 97 | | Occupations Code, as amended by this Act, apply only to an |
---|
98 | 98 | | application for a license under Chapter 1102, Occupations Code, |
---|
99 | 99 | | submitted on or after the effective date of this Act. An |
---|
100 | 100 | | application for a license submitted before the effective date of |
---|
101 | 101 | | this Act is governed by the law in effect on the date the |
---|
102 | 102 | | application was submitted, and the former law is continued in |
---|
103 | 103 | | effect for that purpose. |
---|
104 | 104 | | SECTION 9. This Act takes effect January 1, 2026. |
