77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the execution of a search warrant for taking a blood
1010 specimen from certain persons in certain intoxication offenses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 18.067, Code of Criminal Procedure, is
1313 amended to read as follows:
1414 Art. 18.067. EXECUTION OF WARRANT FOR BLOOD SPECIMEN IN
1515 INTOXICATION OFFENSE. Notwithstanding any other law, a warrant
1616 issued under Article 18.02(a)(10) to collect a blood specimen from
1717 a person suspected of committing an intoxication offense under
1818 Section 49.04, 49.045, 49.05, 49.06, 49.061, 49.065, 49.07, or
1919 49.08, Penal Code, may be executed by any peace officer[:
2020 [(1)] in any county adjacent to the county in which the
2121 warrant was issued[; and
2222 [(2) by any law enforcement officer authorized to make
2323 an arrest in the county of execution].
2424 SECTION 2. The change in law made by this Act applies only
2525 to a search warrant issued on or after the effective date of this
2626 Act. A search warrant issued before the effective date of this Act
2727 is governed by the law in effect on the date the warrant was issued,
2828 and the former law is continued in effect for that purpose.
2929 SECTION 3. This Act takes effect September 1, 2025.
