| 9 | 9 | | relating to the authority of the board of trustees of certain small |

| 10 | 10 | | school districts to decrease the number of trustees on the board. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 11.051, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (d) to read as follows: |
|---|
| 14 | 14 | | (d) A board of trustees of an independent school district |
|---|
| 15 | 15 | | eligible to receive an allotment under Section 48.101(b) that has |
|---|
| 16 | 16 | | seven members may by resolution decrease the membership to five if |
|---|
| 17 | 17 | | the board certifies to the commissioner that in the two preceding |
|---|
| 18 | 18 | | trustee elections the board was unable to fill all trustee seats on |
|---|
| 19 | 19 | | the board. A resolution decreasing the number of trustees takes |
|---|
| 20 | 20 | | effect with the next regular election of trustees that occurs after |
|---|
| 21 | 21 | | the adoption of the resolution and does not shorten the term of any |
|---|
| 22 | 22 | | trustee in office when the resolution is adopted. The resolution |
|---|
| 23 | 23 | | must provide for a transition in the number of trustees so that when |
|---|
| 24 | 24 | | the transition is complete, trustees are elected as provided by |
|---|
| 25 | 25 | | Section 11.059. |
|---|
| 26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2025. |
