77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of municipal solid waste personnel for
1010 the Homes for Texas Heroes home loan program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2306.5621(a), Government Code, is
1313 amended by amending Subdivision (2) and adding Subdivision (17) to
1414 read as follows:
1515 (2) "Home" means a dwelling in this state in which a
1616 fire fighter, corrections officer, county jailer, public security
1717 officer, peace officer, professional educator, veteran, or person
1818 defined as emergency medical services personnel or municipal solid
1919 waste personnel under this section intends to reside as the
2020 borrower's principal residence.
2121 (17) "Municipal solid waste personnel" means a
2222 permanent, full-time employee of a local government who is employed
2323 to collect, sort, process or dispose of solid waste, recyclables,
2424 organics, or household hazardous waste.
2525 SECTION 2. Sections 2306.5621(b), (c), (d), (f), and (h-1),
2626 Government Code, are amended to read as follows:
2727 (b) The corporation shall establish a program to provide
2828 eligible fire fighters, corrections officers, county jailers,
2929 public security officers, peace officers, emergency medical
3030 services personnel, municipal solid waste personnel, professional
3131 educators, and veterans with low-interest home mortgage loans.
3232 (c) To be eligible for a loan under this section, at the time
3333 a person files an application for the loan, the person must:
3434 (1) be a:
3535 (A) fire fighter, corrections officer, county
3636 jailer, public security officer, peace officer, veteran, or person
3737 defined as emergency medical services personnel or municipal solid
3838 waste personnel under this section; or
3939 (B) professional educator who is employed by a
4040 school district or is an allied health or professional nursing
4141 program faculty member in this state;
4242 (2) reside in this state; and
4343 (3) have an income of not more than 115 percent of area
4444 median family income, adjusted for family size, or the maximum
4545 amount permitted by Section 143(f), Internal Revenue Code of 1986,
4646 whichever is greater.
4747 (d) The corporation may contract with other agencies of the
4848 state or with private entities to determine whether applicants
4949 qualify as fire fighters, corrections officers, county jailers,
5050 public security officers, peace officers, emergency medical
5151 services personnel, municipal solid waste personnel, professional
5252 educators, or veterans under this section or otherwise to
5353 administer all or part of this section.
5454 (f) The board of directors of the corporation shall adopt
5555 rules governing:
5656 (1) the administration of the program;
5757 (2) the making of loans under the program;
5858 (3) the criteria for approving mortgage lenders;
5959 (4) the use of insurance on the loans and the homes
6060 financed under the program, as considered appropriate by the board
6161 to provide additional security for the loans;
6262 (5) the verification of occupancy of the home by the
6363 fire fighter, corrections officer, county jailer, public security
6464 officer, peace officer, professional educator, veteran, or person
6565 defined as emergency medical services personnel or municipal solid
6666 waste personnel as the borrower's principal residence; and
6767 (6) the terms of any contract made with any mortgage
6868 lender for processing, originating, servicing, or administering
6969 the loans.
7070 (h-1) To fund home mortgage loans for eligible fire
7171 fighters, corrections officers, county jailers, public security
7272 officers, peace officers, emergency medical services personnel,
7373 municipal solid waste personnel, professional educators, and
7474 veterans under this section, the corporation may use any proceeds
7575 received from the sale of bonds, notes, or other obligations issued
7676 under the home loan program provided by this section, regardless of
7777 any amendments to the eligibility standards for loans made under
7878 the program and regardless of when the corporation received the
7979 proceeds from those bonds, notes, or other obligations issued under
8080 the program.
8181 SECTION 3. This Act takes effect September 1, 2025.
