77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to coroners, including certain state benefits and awards
1010 and membership on the First Responder Advisory Council.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 421.041(b), Government Code, is amended
1313 to read as follows:
1414 (b) The council is composed of:
1515 (1) one representative for each of the following
1616 sectors of the state, appointed by the governor or the governor's
1717 designee:
1818 (A) law enforcement;
1919 (B) firefighters;
2020 (C) private first responders; [and]
2121 (D) emergency medical services; and
2222 (E) coroners, as represented by a justice of the
2323 peace or medical examiner required to conduct inquests under
2424 Chapter 49, Code of Criminal Procedure; and
2525 (2) other members, as determined by the governor or
2626 the governor's designee.
2727 SECTION 2. Section 615.003, Government Code, is amended to
2828 read as follows:
2929 Sec. 615.003. APPLICABILITY. This chapter applies only to
3030 eligible survivors of the following individuals:
3131 (1) an individual:
3232 (A) elected, appointed, or employed as a peace
3333 officer by the state or a political subdivision of the state under
3434 Article 2A.001, Code of Criminal Procedure, or other law; or
3535 (B) employed as a peace officer by a private
3636 institution of higher education, including a private junior
3737 college, that is located in this state under Section 51.212,
3838 Education Code;
3939 (2) a paid probation officer appointed by the director
4040 of a community supervision and corrections department who has the
4141 duties set out in Section 76.002 and the qualifications set out in
4242 Section 76.005, or who was appointed in accordance with prior law;
4343 (3) a parole officer employed by the Texas Department
4444 of Criminal Justice who has the duties set out in Section 508.001
4545 and the qualifications set out in Section 508.113 or in prior law;
4646 (4) a paid jailer;
4747 (5) a member of an organized police reserve or
4848 auxiliary unit who regularly assists peace officers in enforcing
4949 criminal laws;
5050 (6) a member of the class of employees of the
5151 correctional institutions division formally designated as
5252 custodial personnel under Section 615.006 by the Texas Board of
5353 Criminal Justice or its predecessor in function;
5454 (7) a jailer or guard of a county jail who is appointed
5555 by the sheriff and who:
5656 (A) performs a security, custodial, or
5757 supervisory function over the admittance, confinement, or
5858 discharge of prisoners; and
5959 (B) is certified by the Texas Commission on Law
6060 Enforcement;
6161 (8) a juvenile correctional employee of the Texas
6262 Juvenile Justice Department;
6363 (9) an employee of the Department of Aging and
6464 Disability Services or Department of State Health Services who:
6565 (A) works at the department's maximum security
6666 unit; or
6767 (B) performs on-site services for the Texas
6868 Department of Criminal Justice;
6969 (10) an individual who is employed by the state or a
7070 political or legal subdivision and is subject to certification by
7171 the Texas Commission on Fire Protection;
7272 (11) an individual employed by the state or a
7373 political or legal subdivision whose principal duties are aircraft
7474 crash and rescue fire fighting;
7575 (12) a member of an organized volunteer fire-fighting
7676 unit that:
7777 (A) renders fire-fighting services without
7878 remuneration; and
7979 (B) conducts a minimum of two drills each month,
8080 each two hours long;
8181 (13) an individual who:
8282 (A) performs emergency medical services or
8383 operates an ambulance;
8484 (B) is employed by a political subdivision of the
8585 state or is an emergency medical services volunteer as defined by
8686 Section 773.003, Health and Safety Code; and
8787 (C) is qualified as an emergency care attendant
8888 or at a higher level of training under Section 773.046, 773.047,
8989 773.048, 773.049, or 773.0495, Health and Safety Code;
9090 (14) an individual who is employed or formally
9191 designated as a chaplain for:
9292 (A) an organized volunteer fire-fighting unit or
9393 other fire department of this state or of a political subdivision of
9494 this state;
9595 (B) a law enforcement agency of this state or of a
9696 political subdivision of this state; or
9797 (C) the Texas Department of Criminal Justice;
9898 (15) an individual who is employed by the state or a
9999 political subdivision of the state and who is considered by the
100100 governmental employer to be a trainee for a position otherwise
101101 described by this section;
102102 (16) an individual who is employed by the Department
103103 of Public Safety and, as certified by the director, is:
104104 (A) deployed into the field in direct support of
105105 a law enforcement operation, including patrol, investigative,
106106 search and rescue, crime scene, on-site communications, or special
107107 operations; and
108108 (B) given a special assignment in direct support
109109 of operations relating to organized crime, criminal interdiction,
110110 border security, counterterrorism, intelligence, traffic
111111 enforcement, emergency management, regulatory services, or special
112112 investigations; [or]
113113 (17) an individual who is employed by the Parks and
114114 Wildlife Department and, as certified by the executive director of
115115 the Parks and Wildlife Department, is:
116116 (A) deployed into the field in direct support of
117117 a law enforcement operation, including patrol, investigative,
118118 search and rescue, crime scene, on-site communications, or special
119119 operations; and
120120 (B) given a special assignment in direct support
121121 of operations relating to organized crime, criminal interdiction,
122122 border security, counterterrorism, intelligence, traffic
123123 enforcement, emergency management, regulatory services, or special
124124 investigations; or
125125 (18) a justice of the peace or medical examiner
126126 required to conduct inquests under Chapter 49, Code of Criminal
127127 Procedure, or a death investigator or employee who assists the
128128 justice of the peace or medical examiner.
129129 SECTION 3. Section 3106.001, Government Code, is amended by
130130 amending Subdivision (1) and adding Subdivision (1-a) to read as
131131 follows:
132132 (1) "Coroner" means a justice of the peace or medical
133133 examiner required to conduct inquests under Chapter 49, Code of
134134 Criminal Procedure, or a death investigator or employee who assists
135135 the justice of the peace or medical examiner.
136136 (1-a) "Emergency medical first responder" means an
137137 employee or volunteer of the state, a political subdivision, or an
138138 emergency medical services provider who provides urgent on-site
139139 medical care to the sick or injured.
140140 SECTION 4. Chapter 3106, Government Code, is amended by
141141 adding Section 3106.0045 to read as follows:
142142 Sec. 3106.0045. CORONERS' STAR OF TEXAS AWARD. (a) The
143143 Coroners' Star of Texas Award shall be awarded to:
144144 (1) each coroner who is seriously injured in the line
145145 of duty; and
146146 (2) the surviving next of kin of each coroner who is
147147 killed or sustains a fatal injury in the line of duty.
148148 (b) The Coroners' Star of Texas Award Advisory Committee
149149 shall advise the governor on the issuance, design, and presentation
150150 of the Coroners' Star of Texas Award.
151151 (c) The committee consists of three current or retired
152152 coroners appointed by the governor.
153153 SECTION 5. The change in law made by this Act to Chapter
154154 615, Government Code, applies only in relation to a death that
155155 occurs on or after the effective date of this Act. Matters
156156 regarding eligibility, payment, and benefits under Chapter 615,
157157 Government Code, in relation to a death that occurs before the
158158 effective date of this Act are governed by the law in effect when
159159 the death occurs, and the former law is continued in effect for that
160160 purpose.
161161 SECTION 6. This Act takes effect September 1, 2025.
