| 8 | 8 | | relating to the employment of persons by the State Board of |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Education Code, is amended by |
|---|
| 12 | 12 | | adding Section 7.114 to read as follows: |
|---|
| 13 | 13 | | Sec. 7.114. PERSONNEL. (a) The chair of the board may |
|---|
| 14 | 14 | | employ personnel as necessary to assist the board in performing its |
|---|
| 15 | 15 | | duties and may prescribe the personnel's duties and compensation as |
|---|
| 16 | 16 | | provided by legislative appropriation. |
|---|
| 17 | 17 | | (b) A person employed under this section is: |
|---|
| 18 | 18 | | (1) considered an employee of the Texas Education |
|---|
| 19 | 19 | | Agency for the purpose of receiving state employment benefits, |
|---|
| 20 | 20 | | including health insurance and retirement benefits; |
|---|
| 21 | 21 | | (2) entitled to reimbursement for expenses incurred by |
|---|
| 22 | 22 | | the person in the performance of official duties as provided by |
|---|
| 23 | 23 | | legislative appropriation; and |
|---|
| 24 | 24 | | (3) and directly accountable to the chair. |
|---|
| 25 | 25 | | (c) The chair may make all employment actions regarding the |
|---|
| 26 | 26 | | status of a person employed under this section, including the |
|---|
| 27 | 27 | | hiring, promotion, or termination of the person. |
|---|
| 28 | 28 | | (d) The Texas Education Agency shall provide administrative |
|---|
| 29 | 29 | | support services, including human resources, budgetary, |
|---|
| 30 | 30 | | accounting, purchasing, payroll, information technology, and legal |
|---|
| 31 | 31 | | support services, to the board as necessary to carry out the |
|---|
| 32 | 32 | | purposes of this section. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2025. |
