66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the employment of persons by the State Board of
99 Education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Education Code, is amended by
1212 adding Section 7.114 to read as follows:
1313 Sec. 7.114. PERSONNEL. (a) The chair of the board may
1414 employ personnel as necessary to assist the board in performing its
1515 duties and may prescribe the personnel's duties and compensation as
1616 provided by legislative appropriation.
1717 (b) A person employed under this section is:
1818 (1) considered an employee of the Texas Education
1919 Agency for the purpose of receiving state employment benefits,
2020 including health insurance and retirement benefits;
2121 (2) entitled to reimbursement for expenses incurred by
2222 the person in the performance of official duties as provided by
2323 legislative appropriation; and
2424 (3) and directly accountable to the chair.
2525 (c) The chair may make all employment actions regarding the
2626 status of a person employed under this section, including the
2727 hiring, promotion, or termination of the person.
2828 (d) The Texas Education Agency shall provide administrative
2929 support services, including human resources, budgetary,
3030 accounting, purchasing, payroll, information technology, and legal
3131 support services, to the board as necessary to carry out the
3232 purposes of this section.
3333 SECTION 2. This Act takes effect September 1, 2025.
