10	8		AN ACT
11	9		relating to the review and updating by the Texas Water Development
12	10		Board of guidance principles and rules related to certain plans
13	11		adopted or approved by the board.
14	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	13		SECTION 1. Section 16.051, Water Code, is amended by
16	14		amending Subsection (d) and adding Subsection (d-1) to read as
17	15		follows:
18	16		(d) The board, in coordination with the commission, the
19	17		Department of Agriculture, and the Parks and Wildlife Department,
20	18		shall adopt by rule guidance principles for the state water plan
21	19		which reflect the public interest of the entire state. When
22	20		adopting guidance principles, due consideration shall be given to
23	21		the construction and improvement of surface water resources and the
24	22		application of principles that result in voluntary redistribution
25	23		of water resources. The board shall review and update the guidance
26	24		principles and any other rules related to the state water plan, with
27	25		input from the commission, the Department of Agriculture, and the
28	26		Parks and Wildlife Department, as necessary but at least every five
29	27		years to coincide with the five-year cycle for adoption of a new
30	28		water plan as described in Subsection (a).
31	29		(d-1) The requirement to review a rule not later than the
32	30		fourth anniversary of the date on which the rule takes effect and
33	31		every four years after that date under Section 2001.039(b),
34	32		Government Code, does not apply to a rule related to the state water
35	33		plan adopted under this section.
36	34		SECTION 2. Section 16.053, Water Code, is amended by adding
37	35		Subsections (f-1) and (f-2) to read as follows:
38	36		(f-1) The board shall review and update rules adopted under
39	37		this section as necessary but at least every five years to coincide
40	38		with the five-year cycle for adoption of a new water plan as
41	39		described in Section 16.051.
42	40		(f-2) The requirement to review a rule not later than the
43	41		fourth anniversary of the date on which the rule takes effect and
44	42		every four years after that date under Section 2001.039(b),
45	43		Government Code, does not apply to a rule adopted under this
46	44		section.
47	45		SECTION 3. Section 16.061, Water Code, is amended by
48	46		amending Subsection (c) and adding Subsection (c-1) to read as
49	47		follows:
50	48		(c) The board, in coordination with the commission, the
51	49		Department of Agriculture, the General Land Office, the Parks and
52	50		Wildlife Department, the Texas Division of Emergency Management,
53	51		and the State Soil and Water Conservation Board, shall adopt
54	52		guidance principles for the state flood plan that reflect the
55	53		public interest of the entire state. The board shall review and
56	54		revise the guidance principles and any other rules related to the
57	55		state flood plan, with input from the commission, the Department of
58	56		Agriculture, the General Land Office, the Parks and Wildlife
59	57		Department, the Texas Division of Emergency Management, and the
60	58		State Soil and Water Conservation Board as necessary and at least
61	59		every fifth year to coincide with the five-year cycle for adoption
62	60		of a new state flood plan.
63	61		(c-1) The requirement to review a rule not later than the
64	62		fourth anniversary of the date on which the rule takes effect and
65	63		every four years after that date under Section 2001.039(b),
66	64		Government Code, does not apply to a rule adopted under this
67	65		section.
68	66		SECTION 4. Section 16.062, Water Code, is amended by adding
69	67		Subsections (m) and (n) to read as follows:
70	68		(m) The board shall review and update rules adopted under
71	69		this section as necessary but at least every five years to coincide
72		-	with the five-year cycle for adoption of a new ~~state flood~~ plan as
73		-	described in Section 16.~~061~~.

	71	+	described in Section 16.051.
74	72		(n) The requirement to review a rule not later than the
75	73		fourth anniversary of the date on which the rule takes effect and
76	74		every four years after that date under Section 2001.039(b),

78	76		section.
79	77		SECTION 5. This Act takes effect September 1, 2025.
