119 relating to the review and updating by the Texas Water Development
1210 Board of guidance principles and rules related to certain plans
1311 adopted or approved by the board.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1513 SECTION 1. Section 16.051, Water Code, is amended by
1614 amending Subsection (d) and adding Subsection (d-1) to read as
1715 follows:
1816 (d) The board, in coordination with the commission, the
1917 Department of Agriculture, and the Parks and Wildlife Department,
2018 shall adopt by rule guidance principles for the state water plan
2119 which reflect the public interest of the entire state. When
2220 adopting guidance principles, due consideration shall be given to
2321 the construction and improvement of surface water resources and the
2422 application of principles that result in voluntary redistribution
2523 of water resources. The board shall review and update the guidance
2624 principles and any other rules related to the state water plan, with
2725 input from the commission, the Department of Agriculture, and the
2826 Parks and Wildlife Department, as necessary but at least every five
2927 years to coincide with the five-year cycle for adoption of a new
3028 water plan as described in Subsection (a).
3129 (d-1) The requirement to review a rule not later than the
3230 fourth anniversary of the date on which the rule takes effect and
3331 every four years after that date under Section 2001.039(b),
3432 Government Code, does not apply to a rule related to the state water
3533 plan adopted under this section.
3634 SECTION 2. Section 16.053, Water Code, is amended by adding
3735 Subsections (f-1) and (f-2) to read as follows:
3836 (f-1) The board shall review and update rules adopted under
3937 this section as necessary but at least every five years to coincide
4038 with the five-year cycle for adoption of a new water plan as
4139 described in Section 16.051.
4240 (f-2) The requirement to review a rule not later than the
4341 fourth anniversary of the date on which the rule takes effect and
4442 every four years after that date under Section 2001.039(b),
4543 Government Code, does not apply to a rule adopted under this
4644 section.
4745 SECTION 3. Section 16.061, Water Code, is amended by
4846 amending Subsection (c) and adding Subsection (c-1) to read as
4947 follows:
5048 (c) The board, in coordination with the commission, the
5149 Department of Agriculture, the General Land Office, the Parks and
5250 Wildlife Department, the Texas Division of Emergency Management,
5351 and the State Soil and Water Conservation Board, shall adopt
5452 guidance principles for the state flood plan that reflect the
5553 public interest of the entire state. The board shall review and
5654 revise the guidance principles and any other rules related to the
5755 state flood plan, with input from the commission, the Department of
5856 Agriculture, the General Land Office, the Parks and Wildlife
5957 Department, the Texas Division of Emergency Management, and the
6058 State Soil and Water Conservation Board as necessary and at least
6159 every fifth year to coincide with the five-year cycle for adoption
6260 of a new state flood plan.
6361 (c-1) The requirement to review a rule not later than the
6462 fourth anniversary of the date on which the rule takes effect and
6563 every four years after that date under Section 2001.039(b),
6664 Government Code, does not apply to a rule adopted under this
6765 section.
6866 SECTION 4. Section 16.062, Water Code, is amended by adding
6967 Subsections (m) and (n) to read as follows:
7068 (m) The board shall review and update rules adopted under
7169 this section as necessary but at least every five years to coincide
72- with the five-year cycle for adoption of a new state flood plan as
73- described in Section 16.061.
70+ with the five-year cycle for adoption of a new water plan as
71+ described in Section 16.051.
7472 (n) The requirement to review a rule not later than the
7573 fourth anniversary of the date on which the rule takes effect and
7674 every four years after that date under Section 2001.039(b),
7775 Government Code, does not apply to a rule adopted under this
7876 section.
7977 SECTION 5. This Act takes effect September 1, 2025.
