| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 11.061, Education Code, is amended by | |
| 14 | 14 | adding Subsection (b-1) to read as follows: | |
| 15 | 15 | (b-1) A person is not eligible to serve as a trustee of an | |
| 16 | 16 | independent school district if the person is required to register | |
| 17 | 17 | as a sex offender under Chapter 62, Code of Criminal Procedure. | |
| 18 | 18 | SECTION 2. The change in law made by Section 11.061(b-1), | |
| 19 | 19 | Education Code, as added by this Act, applies only to the | |
| 20 | 20 | eligibility of a person to serve on the board of trustees of an | |
| 21 | 21 | independent school district: | |
| 22 | 22 | (1) for a term that begins on or after the effective | |
| 23 | 23 | date of this Act; or | |
| 24 | 24 | (2) to fill a vacancy that occurs on or after the | |
| 25 | 25 | effective date of this Act. | |
| 26 | 26 | SECTION 3. This Act takes effect immediately if it receives | |
| 27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
| 28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
| 29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
| 30 | 30 | Act takes effect September 1, 2025. |
