77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a political subdivision to regulate
1010 fire prevention standards for certain agricultural facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 250, Local Government Code, is amended
1313 by adding Section 250.014 to read as follows:
1414 Sec. 250.014. RESTRICTION ON REGULATION OF CERTAIN
1515 AGRICULTURAL FACILITIES. (a) In this section:
1616 (1) "Agricultural pole barn" means a nonresidential
1717 farm building in which 70 percent or more of the perimeter walls are
1818 permanently open and allow free ingress and egress.
1919 (2) "Nonresidential farm building" means any
2020 temporary or permanent building on a farm, ranch, or other
2121 agricultural facility that is used primarily for agricultural
2222 purposes and not intended to be used as a residential dwelling. The
2323 term includes a barn, greenhouse, shade house, farm office, storage
2424 building, workshop, poultry house, animal handling facility, or
2525 commodity storage and feed processing facility.
2626 (b) Notwithstanding any other law, a political subdivision
2727 may not adopt or enforce an ordinance, order, or other measure that
2828 requires the installation of a fire protection sprinkler system in:
2929 (1) an agricultural pole barn;
3030 (2) a nonresidential farm building;
3131 (3) a cotton gin;
3232 (4) a livestock market, as that term is defined by
3333 Section 161.111, Agriculture Code; or
3434 (5) a commercial feed mill.
3535 SECTION 2. This Act takes effect September 1, 2025.
