| 10 | 10 | | fire prevention standards for certain agricultural facilities. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 250, Local Government Code, is amended |
|---|
| 13 | 13 | | by adding Section 250.014 to read as follows: |
|---|
| 14 | 14 | | Sec. 250.014. RESTRICTION ON REGULATION OF CERTAIN |
|---|
| 15 | 15 | | AGRICULTURAL FACILITIES. (a) In this section: |
|---|
| 16 | 16 | | (1) "Agricultural pole barn" means a nonresidential |
|---|
| 17 | 17 | | farm building in which 70 percent or more of the perimeter walls are |
|---|
| 18 | 18 | | permanently open and allow free ingress and egress. |
|---|
| 19 | 19 | | (2) "Nonresidential farm building" means any |
|---|
| 20 | 20 | | temporary or permanent building on a farm, ranch, or other |
|---|
| 21 | 21 | | agricultural facility that is used primarily for agricultural |
|---|
| 22 | 22 | | purposes and not intended to be used as a residential dwelling. The |
|---|
| 23 | 23 | | term includes a barn, greenhouse, shade house, farm office, storage |
|---|
| 24 | 24 | | building, workshop, poultry house, animal handling facility, or |
|---|
| 25 | 25 | | commodity storage and feed processing facility. |
|---|
| 26 | 26 | | (b) Notwithstanding any other law, a political subdivision |
|---|
| 27 | 27 | | may not adopt or enforce an ordinance, order, or other measure that |
|---|
| 28 | 28 | | requires the installation of a fire protection sprinkler system in: |
|---|
| 29 | 29 | | (1) an agricultural pole barn; |
|---|
| 30 | 30 | | (2) a nonresidential farm building; |
|---|
| 31 | 31 | | (3) a cotton gin; |
|---|
| 32 | 32 | | (4) a livestock market, as that term is defined by |
|---|
| 33 | 33 | | Section 161.111, Agriculture Code; or |
|---|
| 34 | 34 | | (5) a commercial feed mill. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2025. |
