| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 11.061(d), Education Code, is amended | |
| 12 | 12 | to read as follows: | |
| 13 | 13 | (d) The trustees serve without compensation, unless | |
| 14 | 14 | compensation of a specified amount is approved by the district. The | |
| 15 | 15 | trustees' compensation may not be paid from state or federal funds. | |
| 16 | 16 | Notwithstanding this subsection, a person may not receive | |
| 17 | 17 | compensation for serving as a trustee if the person: | |
| 18 | 18 | (1) holds an office other than the position of trustee | |
| 19 | 19 | that is considered a civil office of emolument under Section 40, | |
| 20 | 20 | Article XVI, Texas Constitution; or | |
| 21 | 21 | (2) receives compensation for other services directly | |
| 22 | 22 | or indirectly from the state. | |
| 23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2025. |
