11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Chapter 240, Local Government Code, is amended | |
13 | 13 | by adding Subchapter D to read as follows: | |
14 | 14 | SUBCHAPTER D. COUNTY REGULATION OF NOISE LEVELS | |
15 | 15 | Sec. 240.061. AUTHORITY TO REGULATE. (a) To promote public | |
16 | 16 | health, safety, and welfare, the commissioners court of a county by | |
17 | 17 | order may regulate the level of noise emanating from a residence | |
18 | 18 | located in a residential area in the unincorporated area of the | |
19 | 19 | county. | |
20 | 20 | (b) This section does not authorize the commissioners court | |
21 | 21 | of a county to regulate the use of fireworks. | |
22 | 22 | Sec. 240.062. CRIMINAL PENALTY. (a) A person commits an | |
23 | 23 | offense if the person on two or more occasions violates an order | |
24 | 24 | adopted under this subchapter. | |
25 | 25 | (b) An offense under this section is a Class C misdemeanor. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2025. |
