77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of counties to regulate noise levels in
1010 residential areas; creating a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 240, Local Government Code, is amended
1313 by adding Subchapter D to read as follows:
1414 SUBCHAPTER D. COUNTY REGULATION OF NOISE LEVELS
1515 Sec. 240.061. AUTHORITY TO REGULATE. (a) To promote public
1616 health, safety, and welfare, the commissioners court of a county by
1717 order may regulate the level of noise emanating from a residence
1818 located in a residential area in the unincorporated area of the
1919 county.
2020 (b) This section does not authorize the commissioners court
2121 of a county to regulate the use of fireworks.
2222 Sec. 240.062. CRIMINAL PENALTY. (a) A person commits an
2323 offense if the person on two or more occasions violates an order
2424 adopted under this subchapter.
2525 (b) An offense under this section is a Class C misdemeanor.
2626 SECTION 2. This Act takes effect September 1, 2025.
