| 9 | 9 | | relating to compensation and leave for certain peace officers. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 659.301(5), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (5) "State employee" means an individual who: |
|---|
| 14 | 14 | | (A) is a commissioned law enforcement officer of |
|---|
| 15 | 15 | | the Department of Public Safety, the Texas Facilities Commission, |
|---|
| 16 | 16 | | the Texas Alcoholic Beverage Commission, the Texas Department of |
|---|
| 17 | 17 | | Criminal Justice, the attorney general, the Texas Commission on Law |
|---|
| 18 | 18 | | Enforcement, or the insurance fraud unit of the Texas Department of |
|---|
| 19 | 19 | | Insurance; |
|---|
| 20 | 20 | | (B) is a commissioned security officer of the |
|---|
| 21 | 21 | | comptroller; |
|---|
| 22 | 22 | | (C) is a law enforcement officer commissioned by |
|---|
| 23 | 23 | | the Parks and Wildlife Commission; |
|---|
| 24 | 24 | | (D) is a commissioned peace officer of an |
|---|
| 25 | 25 | | institution of higher education; |
|---|
| 26 | 26 | | (E) is an employee or official of the Board of |
|---|
| 27 | 27 | | Pardons and Paroles or the parole division of the Texas Department |
|---|
| 28 | 28 | | of Criminal Justice if the employee or official has routine direct |
|---|
| 29 | 29 | | contact with inmates of any penal or correctional institution or |
|---|
| 30 | 30 | | with administratively released prisoners subject to the board's |
|---|
| 31 | 31 | | jurisdiction; |
|---|
| 32 | 32 | | (F) has been certified to the Employees |
|---|
| 33 | 33 | | Retirement System of Texas under Section 815.505 as having begun |
|---|
| 34 | 34 | | employment as a law enforcement officer or custodial officer, |
|---|
| 35 | 35 | | unless the individual has been certified to the system as having |
|---|
| 36 | 36 | | ceased employment as a law enforcement officer or custodial |
|---|
| 37 | 37 | | officer; |
|---|
| 38 | 38 | | (G) before May 29, 1987, received hazardous duty |
|---|
| 39 | 39 | | pay based on the terms of any state law if the individual holds a |
|---|
| 40 | 40 | | position designated under that law as eligible for the pay; or |
|---|
| 41 | 41 | | (H) is a security officer employed by the Texas |
|---|
| 42 | 42 | | Military Department. |
|---|
| 43 | 43 | | SECTION 2. Section 661.918(a), Government Code, is amended |
|---|
| 44 | 44 | | to read as follows: |
|---|
| 45 | 45 | | (a) This section applies to a peace officer under Article |
|---|
| 46 | 46 | | 2A.001, Code of Criminal Procedure, who is commissioned as a law |
|---|
| 47 | 47 | | enforcement officer or agent, including a ranger, by: |
|---|
| 48 | 48 | | (1) the Public Safety Commission and the director of |
|---|
| 49 | 49 | | the Department of Public Safety; |
|---|
| 50 | 50 | | (2) the Parks and Wildlife Commission; |
|---|
| 51 | 51 | | (3) the Texas Alcoholic Beverage Commission; |
|---|
| 52 | 52 | | (4) the attorney general; [or] |
|---|
| 53 | 53 | | (5) the insurance fraud unit of the Texas Department |
|---|
| 54 | 54 | | of Insurance; [or] |
|---|
| 55 | 55 | | (6) the comptroller; or |
|---|
| 56 | 56 | | (7) the Texas Commission on Law Enforcement. |

| 57 | 57 | | SECTION 3. Section 1701.160, Occupations Code, is amended |
|---|
| 58 | 58 | | to read as follows: |
|---|
| 59 | 59 | | Sec. 1701.160. AUTHORITY TO COMMISSION INVESTIGATORS AS |
|---|
| 60 | 60 | | PEACE OFFICERS. (a) The commission may commission certified peace |
|---|
| 61 | 61 | | officers as investigators employed by the commission for the |
|---|
| 62 | 62 | | limited purpose of assisting the commission in administering this |
|---|
| 63 | 63 | | chapter. |
|---|
| 64 | 64 | | (b) The commission shall ensure a peace officer |
|---|
| 65 | 65 | | commissioned under Subsection (a) is compensated according to |
|---|
| 66 | 66 | | Schedule C of the position classification salary schedule |
|---|
| 67 | 67 | | prescribed by the General Appropriations Act. |
|---|
| 68 | 68 | | SECTION 4. (a) The classification officer in the office of |
|---|
| 69 | 69 | | the state auditor shall classify the position of commissioned peace |
|---|
| 70 | 70 | | officer employed by the Texas Commission on Law Enforcement as a |
|---|
| 71 | 71 | | Schedule C position under the position classification plan |
|---|
| 72 | 72 | | maintained under Chapter 654, Government Code. |
|---|
| 73 | 73 | | (b) The change made by the classification officer as |
|---|
| 74 | 74 | | required by this section applies beginning with the state fiscal |
|---|
| 75 | 75 | | biennium beginning September 1, 2025. |
|---|
| 76 | 76 | | (c) This section expires September 1, 2027. |
|---|
| 77 | 77 | | SECTION 5. Section 661.918(a), Government Code, as amended |
|---|
| 78 | 78 | | by this Act, applies only to an injury that occurs on or after the |
|---|
| 79 | 79 | | effective date of this Act. |
|---|
| 80 | 80 | | SECTION 6. This Act takes effect September 1, 2025. |
