88 AN ACT
99 relating to continuing education program contents and format
1010 relating to building codes for insurance adjusters.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 4004.105, Insurance Code, is amended to
1313 read as follows:
1414 Sec. 4004.105. ADJUSTER CONTINUING EDUCATION PROGRAM
1515 CONTENTS AND FORMAT. (a) A continuing education program for
1616 adjusters licensed under Chapter 4101 must include education
1717 relating to:
1818 (1) Chapter 541;
1919 (2) Chapter 547;
2020 (3) Subchapter A, Chapter 542;
2121 (4) Subchapter E, Chapter 17, Business & Commerce
2222 Code; [and]
2323 (5) state and local building codes that is at least one
2424 hour in each licensing period and includes information relating to:
2525 (A) damage assessment and claim adjustment;
2626 (B) policy coverage interpretations involving
2727 building codes; and
2828 (C) mitigation and reconstruction standards
2929 applicable to insured losses; and
3030 (6) any other similar laws specified by the
3131 department.
3232 (b) In relation to a course instructing an adjuster licensed
3333 under Chapter 4101 on building code requirements under Subsection
3434 (a), the department shall:
3535 (1) develop the course or certify a continuing
3636 education program with the course under Section 4004.101; and
3737 (2) ensure that the course is available through
3838 continuing education program providers in multiple formats,
3939 including a classroom setting, an online setting, and self-paced
4040 study.
4141 SECTION 2. This Act takes effect September 1, 2025.
