| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 4004.105, Insurance Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | Sec. 4004.105. ADJUSTER CONTINUING EDUCATION PROGRAM |
|---|
| 15 | 15 | | CONTENTS AND FORMAT. (a) A continuing education program for |
|---|
| 16 | 16 | | adjusters licensed under Chapter 4101 must include education |
|---|
| 17 | 17 | | relating to: |
|---|
| 18 | 18 | | (1) Chapter 541; |
|---|
| 19 | 19 | | (2) Chapter 547; |
|---|
| 20 | 20 | | (3) Subchapter A, Chapter 542; |
|---|
| 21 | 21 | | (4) Subchapter E, Chapter 17, Business & Commerce |
|---|
| 22 | 22 | | Code; [and] |
|---|
| 23 | 23 | | (5) state and local building codes that is at least one |
|---|
| 24 | 24 | | hour in each licensing period and includes information relating to: |
|---|
| 25 | 25 | | (A) damage assessment and claim adjustment; |
|---|
| 26 | 26 | | (B) policy coverage interpretations involving |
|---|
| 27 | 27 | | building codes; and |
|---|
| 28 | 28 | | (C) mitigation and reconstruction standards |
|---|
| 29 | 29 | | applicable to insured losses; and |
|---|
| 30 | 30 | | (6) any other similar laws specified by the |
|---|
| 31 | 31 | | department. |
|---|
| 32 | 32 | | (b) In relation to a course instructing an adjuster licensed |
|---|
| 33 | 33 | | under Chapter 4101 on building code requirements under Subsection |
|---|
| 34 | 34 | | (a), the department shall: |
|---|
| 35 | 35 | | (1) develop the course or certify a continuing |
|---|
| 36 | 36 | | education program with the course under Section 4004.101; and |
|---|
| 37 | 37 | | (2) ensure that the course is available through |
|---|
| 38 | 38 | | continuing education program providers in multiple formats, |
|---|
| 39 | 39 | | including a classroom setting, an online setting, and self-paced |
|---|
| 40 | 40 | | study. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2025. |
