88 AN ACT
99 relating to the compensation to a county for certain persons
1010 confined in a county jail pending trial.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 17, Code of Criminal Procedure, is
1313 amended by adding Article 17.54 to read as follows:
1414 Art. 17.54. COMPENSATION TO COUNTY FOR DEFENDANT NOT
1515 RELEASED ON BAIL. If a defendant charged with an offense punishable
1616 as a felony is not released on bail pending trial, the state shall
1717 compensate the county for the cost of confining the defendant in the
1818 county jail pending trial.
1919 SECTION 2. The change in law made by this Act applies only
2020 to compensation to a county for the cost of a defendant's
2121 confinement that occurs on or after January 1, 2026, regardless of
2222 whether the defendant is confined before, on, or after that date.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2025.
