66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the time allowed for the issuance of a permit or
99 license.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 245, Local Government Code, is amended
1212 by adding Section 245.008 to read as follows:
1313 Sec. 245.008. ISSUANCE OF A PERMIT OR LICENSE. (a) A
1414 political subdivision shall, in a manner accessible to the public
1515 and on their Internet site, post the requirements necessary,
1616 including a list of all required elements, for the submission of a
1717 complete application for a permit or license by an applicant.
1818 (b) A political subdivision must issue a permit or license
1919 within 14 days of the filing of a complete application for a permit
2020 or license required by a political subdivision for a project.
2121 (c) If a series of permits or licenses is required, a
2222 political subdivision must issue a permit or license within 14 days
2323 of the filing of each complete application for a permit or license
2424 required by a political subdivision.
2525 (d) Notwithstanding any provision of this chapter, a
2626 political subdivision may not prohibit the concurrent application
2727 for permits or licenses by an applicant.
2828 (e) If a political subdivision is unable to issue a permit
2929 or license within 14 days of the submission of a complete
3030 application, the political subdivision must refund any fee
3131 associated with the application for a permit or license to the
3232 applicant.
3333 (f) If a political subdivision is unable to issue a permit
3434 or license within 21 days of the submission of a complete
3535 application, the political subdivision must refund any fee
3636 associated with the application for a permit or license plus an
3737 additional 50 percent of the fee associated with the application
3838 for a permit or license to the applicant.
3939 (g) This section does not apply to a permit or license
4040 required for the completion of a project that involves the new
4141 construction or a building.
4242 (h) This section does not apply to a zoning application
4343 under Chapter 211, Local Government Code.
4444 SECTION 2. Chapter 61, Alcoholic Beverage Code, is amended
4545 by adding Section 61.53 to read as follows:
4646 Sec. 61.53. ISSUANCE OF A LICENSE. (a) Notwithstanding any
4747 other provision of this code, the commission shall issue a license
4848 within 21 days of receiving an original application for a license or
4949 the renewal of a license.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2025.
