| 8 | 8 | | relating to the time allowed for the issuance of a permit or |

| 9 | 9 | | license. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 245, Local Government Code, is amended |
|---|
| 12 | 12 | | by adding Section 245.008 to read as follows: |
|---|
| 13 | 13 | | Sec. 245.008. ISSUANCE OF A PERMIT OR LICENSE. (a) A |
|---|
| 14 | 14 | | political subdivision shall, in a manner accessible to the public |
|---|
| 15 | 15 | | and on their Internet site, post the requirements necessary, |
|---|
| 16 | 16 | | including a list of all required elements, for the submission of a |
|---|
| 17 | 17 | | complete application for a permit or license by an applicant. |
|---|
| 18 | 18 | | (b) A political subdivision must issue a permit or license |
|---|
| 19 | 19 | | within 14 days of the filing of a complete application for a permit |
|---|
| 20 | 20 | | or license required by a political subdivision for a project. |
|---|
| 21 | 21 | | (c) If a series of permits or licenses is required, a |
|---|
| 22 | 22 | | political subdivision must issue a permit or license within 14 days |
|---|
| 23 | 23 | | of the filing of each complete application for a permit or license |
|---|
| 24 | 24 | | required by a political subdivision. |
|---|
| 25 | 25 | | (d) Notwithstanding any provision of this chapter, a |
|---|
| 26 | 26 | | political subdivision may not prohibit the concurrent application |
|---|
| 27 | 27 | | for permits or licenses by an applicant. |
|---|
| 28 | 28 | | (e) If a political subdivision is unable to issue a permit |
|---|
| 29 | 29 | | or license within 14 days of the submission of a complete |
|---|
| 30 | 30 | | application, the political subdivision must refund any fee |
|---|
| 31 | 31 | | associated with the application for a permit or license to the |
|---|
| 32 | 32 | | applicant. |
|---|
| 33 | 33 | | (f) If a political subdivision is unable to issue a permit |
|---|
| 34 | 34 | | or license within 21 days of the submission of a complete |
|---|
| 35 | 35 | | application, the political subdivision must refund any fee |
|---|
| 36 | 36 | | associated with the application for a permit or license plus an |
|---|
| 37 | 37 | | additional 50 percent of the fee associated with the application |
|---|
| 38 | 38 | | for a permit or license to the applicant. |
|---|
| 39 | 39 | | (g) This section does not apply to a permit or license |
|---|
| 40 | 40 | | required for the completion of a project that involves the new |
|---|
| 41 | 41 | | construction or a building. |
|---|
| 42 | 42 | | (h) This section does not apply to a zoning application |
|---|
| 43 | 43 | | under Chapter 211, Local Government Code. |
|---|
| 44 | 44 | | SECTION 2. Chapter 61, Alcoholic Beverage Code, is amended |
|---|
| 45 | 45 | | by adding Section 61.53 to read as follows: |
|---|
| 46 | 46 | | Sec. 61.53. ISSUANCE OF A LICENSE. (a) Notwithstanding any |
|---|
| 47 | 47 | | other provision of this code, the commission shall issue a license |
|---|
| 48 | 48 | | within 21 days of receiving an original application for a license or |
|---|
| 49 | 49 | | the renewal of a license. |
|---|
| 50 | 50 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 54 | 54 | | Act takes effect September 1, 2025. |
