88 AN ACT
99 relating to the creation of an extracurricular community education
1010 grant program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 29.251, Education Code, is amended to
1313 read as follows:
1414 Sec. 29.251. DEFINITION [DEFINITIONS]. In this subchapter,
1515 "community[:
1616 [(4) "Community] education" means the process by which
1717 the citizens in a school district, using the resources and
1818 facilities of the district or an eligible organization, organize to
1919 support each other and to solve their mutual educational problems
2020 and meet their mutual lifelong needs. Community education may
2121 include:
2222 (1) [(A)] educational programs, including programs
2323 relating to cultural awareness, parenting skills education and
2424 parental involvement in school programs, and multilevel adult
2525 education and personal growth;
2626 (2) [(B)] community involvement programs, including
2727 programs for community economic development, school volunteers,
2828 partnerships between schools and businesses, coordination with
2929 community agencies, school-age child care, family literacy, and
3030 community use of facilities; and
3131 (3) [(C)] programs for youth enrolled in schools,
3232 including [programs for] dropout prevention and recovery programs,
3333 drug-free school programs, school-age parenting programs, and
3434 academic enhancement programs provided both during and outside of
3535 regular school hours.
3636 SECTION 2. Subchapter H, Chapter 29, Education Code, is
3737 amended by adding Section 29.258 to read as follows:
3838 Sec. 29.258. EXTRACURRICULAR COMMUNITY EDUCATION GRANT
3939 PROGRAM. (a) In this section, "extracurricular community
4040 education program" means a community education program for youth
4141 enrolled in schools that is provided outside of regular school
4242 hours, including programs provided after school or during the
4343 summer.
4444 (b) The commissioner shall establish a grant program to
4545 assist eligible organizations with providing extracurricular
4646 community education programs that promote learning and academic
4747 enrichment and may include activities involving art, music,
4848 community engagement, literacy, science, technology, engineering,
4949 math, health, mental health, or recreation.
5050 (c) The objectives of the grant program established by this
5151 section are to:
5252 (1) improve student academic performance by
5353 increasing access to after-school and summer learning and
5454 enrichment opportunities;
5555 (2) reduce truancy by fostering student engagement in
5656 learning and connections to the school and community;
5757 (3) improve student mental health by identifying those
5858 in need and providing early intervention to students and their
5959 families;
6060 (4) increase student access to protective factors that
6161 promote healthy behaviors, attitudes, and relationships, including
6262 access to connections with caring adults;
6363 (5) encourage students to develop the skills and
6464 behaviors necessary to become productive adults, including those
6565 necessary to succeed in postsecondary education or career
6666 opportunities; and
6767 (6) establish community partnerships to ensure
6868 equitable access to resources for students and their families.
6969 (d) To be eligible for a grant under this section, an
7070 organization that provides or seeks to provide an extracurricular
7171 community education program must submit a grant application to the
7272 agency that includes:
7373 (1) an assessment of community needs and existing
7474 program resources, including a description of the extent to which:
7575 (A) students and their families were involved in
7676 the determination of community needs; and
7777 (B) the program addresses or will address the
7878 identified needs;
7979 (2) a description of the organization's relationship
8080 with a public school that the students participating in the program
8181 attend, if applicable;
8282 (3) an analysis of the extent to which the program will
8383 further the objectives described by Subsection (c);
8484 (4) a plan for implementing educational strategies
8585 consistent with industry best practices and for providing program
8686 staff with access to professional development opportunities; and
8787 (5) a description of the data the organization will
8888 use to evaluate the impact of the program.
8989 (e) The commissioner shall adopt rules necessary to
9090 administer the grant program established by this section, including
9191 rules to:
9292 (1) establish a methodology for selecting among
9393 eligible organizations that have applied under Subsection (d) to
9494 receive grants that prioritizes:
9595 (A) programs primarily serving historically
9696 underserved students;
9797 (B) organizations partnered or otherwise
9898 collaborating with public schools that program participants
9999 attend; and
100100 (C) organizations providing a wide array of
101101 services and activities to meet community needs and the objectives
102102 described by Subsection (c); and
103103 (2) monitor and evaluate the performance of grant
104104 recipients, including assessing the effectiveness of a program in
105105 meeting the objectives described by Subsection (c).
106106 (f) To the extent practicable, the commissioner shall award
107107 grants under this section:
108108 (1) equitably among the geographic areas of the state,
109109 including urban, rural, and suburban communities; and
110110 (2) without regard to the grade level of students
111111 served by a program.
112112 (g) The agency shall provide program development assistance
113113 to organizations that receive a grant under this section, including
114114 professional development opportunities for program leaders and
115115 guidance on educational strategies consistent with industry best
116116 practices.
117117 SECTION 3. As soon as practicable after the effective date
118118 of this Act, the commissioner of education shall establish the
119119 extracurricular community education grant program under Section
120120 29.258, Education Code, as added by this Act, and adopt all rules
121121 necessary for the implementation of that section.
122122 SECTION 4. This Act takes effect immediately if it receives
123123 a vote of two-thirds of all the members elected to each house, as
124124 provided by Section 39, Article III, Texas Constitution. If this
125125 Act does not receive the vote necessary for immediate effect, this
126126 Act takes effect September 1, 2025.
