9 | 9 | relating to the issuance of a provisional occupational license to | |
10 | 10 | certain applicants with criminal convictions. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Sections 53.0211(b) and (c), Occupations Code, | |
13 | 13 | are amended to read as follows: | |
14 | 14 | (b) Notwithstanding any law other than Subsection (a) and | |
15 | 15 | unless the applicant has been convicted of an offense described by | |
16 | 16 | Section 53.021(a), a licensing authority shall issue to an | |
17 | 17 | otherwise qualified applicant who has been convicted of an offense: | |
18 | 18 | (1) the license for which the applicant applied; or | |
19 | 19 | (2) a provisional license valid for a term of six | |
20 | 20 | months [described by Subsection (c)]. | |
21 | 21 | (c) The term of a provisional license issued to an applicant | |
22 | 22 | who is an inmate imprisoned in the Texas Department of Criminal | |
23 | 23 | Justice begins on the date the applicant is released [A licensing | |
24 | 24 | authority may issue a provisional license for a term of six months | |
25 | 25 | to an applicant who has been convicted of an offense]. | |
26 | 26 | SECTION 2. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2025. |
