77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the issuance of a provisional occupational license to
1010 certain applicants with criminal convictions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 53.0211(b) and (c), Occupations Code,
1313 are amended to read as follows:
1414 (b) Notwithstanding any law other than Subsection (a) and
1515 unless the applicant has been convicted of an offense described by
1616 Section 53.021(a), a licensing authority shall issue to an
1717 otherwise qualified applicant who has been convicted of an offense:
1818 (1) the license for which the applicant applied; or
1919 (2) a provisional license valid for a term of six
2020 months [described by Subsection (c)].
2121 (c) The term of a provisional license issued to an applicant
2222 who is an inmate imprisoned in the Texas Department of Criminal
2323 Justice begins on the date the applicant is released [A licensing
2424 authority may issue a provisional license for a term of six months
2525 to an applicant who has been convicted of an offense].
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2025.
