77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to consideration of criminal history of applicants for
1010 public employment.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 6, Government Code, is amended
1313 by adding Chapter 621 to read as follows:
1414 CHAPTER 621. CONSIDERATION OF CRIMINAL HISTORY OF APPLICANTS FOR
1515 PUBLIC EMPLOYMENT
1616 Sec. 621.001. DEFINITION. In this chapter, "public
1717 employer" means:
1818 (1) a board, a commission, an office, a department, or
1919 another agency in the executive, judicial, or legislative branch of
2020 state government, including an institution of higher education, as
2121 that term is defined by Section 61.003, Education Code; or
2222 (2) a political subdivision of this state.
2323 Sec. 621.002. NONAPPLICABILITY. This chapter does not
2424 apply to:
2525 (1) an independent school district; or
2626 (2) any position with a law enforcement agency for
2727 which a license is required under Chapter 1701, Occupations Code.
2828 Sec. 621.003. CRIMINAL HISTORY OF APPLICANTS FOR PUBLIC
2929 EMPLOYMENT. (a) Except as provided by Subsection (b), before
3030 making a conditional offer of employment to an applicant, a public
3131 employer may not:
3232 (1) obtain criminal history record information
3333 relating to the applicant; or
3434 (2) ask the applicant to disclose orally or in writing
3535 information regarding the applicant's criminal history, if any.
3636 (b) Before making a conditional offer of employment, a
3737 public employer may:
3838 (1) notify the applicant for a position that certain
3939 criminal convictions disqualify the applicant from consideration
4040 for the position under law or the employer's written policy; or
4141 (2) include a question on an initial employment
4242 application form regarding whether an applicant has been convicted
4343 of a criminal offense that would disqualify the applicant from
4444 employment under law if the question is limited to offenses that
4545 result in disqualification.
4646 (c) This section does not prohibit a public employer from
4747 obtaining criminal history record information after the public
4848 employer has made a conditional offer of employment to an
4949 applicant.
5050 SECTION 2. The changes in law made by this Act apply only to
5151 an employment application submitted on or after the effective date
5252 of this Act. An employment application submitted before the
5353 effective date of this Act is governed by the law in effect on the
5454 date the application was submitted, and the former law is continued
5555 in effect for that purpose.
5656 SECTION 3. This Act takes effect September 1, 2025.
