| 12 | 12 | SECTION 1. Subchapter A, Chapter 34, Utilities Code, is | |
| 13 | 13 | amended by adding Section 34.0111 to read as follows: | |
| 14 | 14 | Sec. 34.0111. PRIORITIZATION OF AWARDS. The commission | |
| 15 | 15 | shall prioritize the award of a grant or loan under this subchapter | |
| 16 | 16 | for an electric generating facility with a generation capacity of | |
| 17 | 17 | at least 750 megawatts. | |
| 18 | 18 | SECTION 2. Section 34.0111, Utilities Code, as added by | |
| 19 | 19 | this Act, applies only to an application for a grant or loan | |
| 20 | 20 | submitted to the Public Utility Commission of Texas under | |
| 21 | 21 | Subchapter A, Chapter 34, Utilities Code, on or after the effective | |
| 22 | 22 | date of this Act. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2025. |
