77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to certification requirements for a fire marshal and any
1010 related employee, officer, inspector, and investigator appointed
1111 by certain counties and emergency services districts.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter F, Chapter 775, Health and Safety
1414 Code, is amended by adding Section 775.1025 to read as follows:
1515 Sec. 775.1025. CERTIFICATION REQUIREMENTS FOR DISTRICTS
1616 LOCATED IN CERTAIN COUNTIES. (a) This section applies only to a
1717 district wholly located in a county with a population of 100,000 or
1818 more.
1919 (b) The fire marshal shall hold the following
2020 certifications issued by the Texas Commission on Fire Protection:
2121 (1) head of a prevention-only fire department
2222 certification not later than 12 months after the date the marshal is
2323 initially appointed;
2424 (2) a fire marshal basic certification not later than
2525 24 months after the date the marshal is initially appointed; and
2626 (3) a fire protection personnel certification not
2727 later than 12 months after the date the marshal is initially
2828 appointed.
2929 (c) If acting as a peace officer, the fire marshal and any
3030 related officer, inspector, and investigator must hold a permanent
3131 peace officer license issued under Chapter 1701, Occupations Code.
3232 (d) If acting under fire marshal authority to conduct or
3333 supervise arson investigations or fire inspections, the fire
3434 marshal or the marshal's employees must hold certifications
3535 required for fire inspection by the Texas Commission on Fire
3636 Protection under Chapter 419, Government Code.
3737 SECTION 2. Subchapter B, Chapter 352, Local Government
3838 Code, is amended by adding Section 352.0125 to read as follows:
3939 Sec. 352.0125. CERTIFICATION REQUIREMENTS IN CERTAIN
4040 COUNTIES. (a) This section applies only to a county with a
4141 population of 100,000 or more.
4242 (b) A county fire marshal shall hold the following
4343 certifications issued by the Texas Commission on Fire Protection:
4444 (1) head of a prevention-only fire department
4545 certification not later than 12 months after the date the marshal is
4646 initially appointed;
4747 (2) a fire marshal basic certification not later than
4848 24 months after the date the marshal is initially appointed; and
4949 (3) a fire protection personnel certification not
5050 later than 12 months after the date the marshal is initially
5151 appointed.
5252 (c) If acting as a peace officer, a county fire marshal and
5353 any related officer, inspector, and investigator must hold a
5454 permanent peace officer license issued under Chapter 1701,
5555 Occupations Code.
5656 (d) If acting under fire marshal authority to conduct or
5757 supervise arson investigations or fire inspections, a county fire
5858 marshal or the marshal's employees must hold certifications
5959 required for fire inspection by the Texas Commission on Fire
6060 Protection under Chapter 419, Government Code.
6161 SECTION 3. Notwithstanding Sections 775.1025, Health and
6262 Safety Code, and 352.0125, Local Government Code, as added by this
6363 Act, a fire marshal for a county with a population of 100,000 or
6464 more or for an emergency services district wholly located in a
6565 county with a population of 100,000 or more initially appointed
6666 before the effective date of this Act must receive the following
6767 certifications:
6868 (1) head of a suppression fire department
6969 certification issued by the Texas Commission on Fire Protection not
7070 later than 12 months after the effective date of this Act;
7171 (2) head of a prevention-only fire department
7272 certification issued by the Texas Commission on Fire Protection not
7373 later than 12 months after the effective date of this Act;
7474 (3) a fire marshal basic certification issued by the
7575 Texas Commission on Fire Protection not later than 24 months after
7676 the effective date of this Act;
7777 (4) a fire protection personnel certification issued
7878 by the Texas Commission on Fire Protection not later than 12 months
7979 after the effective date of this Act; and
8080 (5) if acting as a peace officer, a permanent peace
8181 officer license issued under Chapter 1701, Occupations Code.
8282 SECTION 4. This Act takes effect September 1, 2025.
