10 | 10 | | voting ballot by mail by certain persons. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Sections 84.001(b) and (d), Election Code, are |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (b) Subject to Section 1.011 and except as provided by |
---|
15 | 15 | | Section 84.0091, an application must be submitted in writing and |
---|
16 | 16 | | signed by the applicant using ink on paper. An electronic signature |
---|
17 | 17 | | or photocopied signature is not permitted except as provided by |
---|
18 | 18 | | Section 84.0091. |
---|
19 | 19 | | (d) An application must be submitted [by mail] to the early |
---|
20 | 20 | | voting clerk for the election who serves the election precinct of |
---|
21 | 21 | | the applicant's residence. |
---|
22 | 22 | | SECTION 2. Section 84.007(a), Election Code, is amended to |
---|
23 | 23 | | read as follows: |
---|
24 | 24 | | (a) Except as provided by Sections 84.008, [and] 84.009, and |
---|
25 | 25 | | 84.0091, an application for a ballot to be voted by mail must be |
---|
26 | 26 | | submitted as provided by this section. |
---|
27 | 27 | | SECTION 3. Subchapter A, Chapter 84, Election Code, is |
---|
28 | 28 | | amended by adding Section 84.0091 to read as follows: |
---|
29 | 29 | | Sec. 84.0091. SUBMITTING CERTAIN APPLICATIONS FOR BALLOT |
---|
30 | 30 | | VOTED BY MAIL: ELECTRONIC SUBMISSION. (a) The secretary of state |
---|
31 | 31 | | shall implement a program to allow a person 65 years of age or older |
---|
32 | 32 | | to complete an application for an early voting ballot by mail over |
---|
33 | 33 | | the Internet from the official website of this state and from the |
---|
34 | 34 | | Internet website of the county in which the person is registered to |
---|
35 | 35 | | vote. The program must: |
---|
36 | 36 | | (1) permit an applicant to electronically sign the |
---|
37 | 37 | | application; |
---|
38 | 38 | | (2) deliver a completed application to the early |
---|
39 | 39 | | voting clerk for the election who serves the election precinct of |
---|
40 | 40 | | the applicant's residence; and |
---|
41 | 41 | | (3) permit an applicant to check the status of the |
---|
42 | 42 | | applicant's application. |
---|
43 | 43 | | (b) The program implemented under Subsection (a) must |
---|
44 | 44 | | require a person 65 years of age or older to provide the following |
---|
45 | 45 | | information before allowing the person to complete an application |
---|
46 | 46 | | for an early voting ballot by mail: |
---|
47 | 47 | | (1) the person's name and voter registration number or |
---|
48 | 48 | | registration address; |
---|
49 | 49 | | (2) the person's driver's license number or personal |
---|
50 | 50 | | identification card number issued by the Department of Public |
---|
51 | 51 | | Safety; and |
---|
52 | 52 | | (3) the last four digits of the person's social |
---|
53 | 53 | | security number. |
---|
54 | 54 | | SECTION 4. This Act takes effect September 1, 2025. |
