77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to electronic submission of an application for an early
1010 voting ballot by mail by certain persons.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 84.001(b) and (d), Election Code, are
1313 amended to read as follows:
1414 (b) Subject to Section 1.011 and except as provided by
1515 Section 84.0091, an application must be submitted in writing and
1616 signed by the applicant using ink on paper. An electronic signature
1717 or photocopied signature is not permitted except as provided by
1818 Section 84.0091.
1919 (d) An application must be submitted [by mail] to the early
2020 voting clerk for the election who serves the election precinct of
2121 the applicant's residence.
2222 SECTION 2. Section 84.007(a), Election Code, is amended to
2323 read as follows:
2424 (a) Except as provided by Sections 84.008, [and] 84.009, and
2525 84.0091, an application for a ballot to be voted by mail must be
2626 submitted as provided by this section.
2727 SECTION 3. Subchapter A, Chapter 84, Election Code, is
2828 amended by adding Section 84.0091 to read as follows:
2929 Sec. 84.0091. SUBMITTING CERTAIN APPLICATIONS FOR BALLOT
3030 VOTED BY MAIL: ELECTRONIC SUBMISSION. (a) The secretary of state
3131 shall implement a program to allow a person 65 years of age or older
3232 to complete an application for an early voting ballot by mail over
3333 the Internet from the official website of this state and from the
3434 Internet website of the county in which the person is registered to
3535 vote. The program must:
3636 (1) permit an applicant to electronically sign the
3737 application;
3838 (2) deliver a completed application to the early
3939 voting clerk for the election who serves the election precinct of
4040 the applicant's residence; and
4141 (3) permit an applicant to check the status of the
4242 applicant's application.
4343 (b) The program implemented under Subsection (a) must
4444 require a person 65 years of age or older to provide the following
4545 information before allowing the person to complete an application
4646 for an early voting ballot by mail:
4747 (1) the person's name and voter registration number or
4848 registration address;
4949 (2) the person's driver's license number or personal
5050 identification card number issued by the Department of Public
5151 Safety; and
5252 (3) the last four digits of the person's social
5353 security number.
5454 SECTION 4. This Act takes effect September 1, 2025.
