| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 208.002(a), Labor Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 208.002. INITIAL CLAIM; LAST WORK. (a) When used in |
|---|
| 14 | 14 | | connection with an initial claim, "last work" and "person for whom |
|---|
| 15 | 15 | | the claimant last worked refers to : |
|---|
| 16 | 16 | | (1) the last person for whom the claimant actually |
|---|
| 17 | 17 | | worked, if the claimant worked for that person for at least 30 hours |
|---|
| 18 | 18 | | during a week; or |
|---|
| 19 | 19 | | (2) the employer, as defined by Subchapter C, Chapter |
|---|
| 20 | 20 | | 201, or by the unemployment law of any other state, for whom the |
|---|
| 21 | 21 | | claimant last worked., unless otherwise required by state or |
|---|
| 22 | 22 | | federal law. |
|---|
| 23 | 23 | | (b) The commission shall mail a notice of the filing of an |
|---|
| 24 | 24 | | initial claim to the person for whom the claimant last worked before |
|---|
| 25 | 25 | | the effective date of the initial claim. If the person for whom the |
|---|
| 26 | 26 | | claimant last worked has more than one branch or division operating |
|---|
| 27 | 27 | | at different locations, the commission shall mail the notice to the |
|---|
| 28 | 28 | | branch or division at which the claimant last worked. |
|---|
| 29 | 29 | | (c) Mailing of a notice under this section to the correct |
|---|
| 30 | 30 | | address of the person, branch, or division for which the claimant |
|---|
| 31 | 31 | | last worked constitutes notice of the claim to the person. |
|---|
| 32 | 32 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 33 | 33 | | to a claim for unemployment compensation benefits that is filed |
|---|
| 34 | 34 | | with the Texas Workforce Commission on or after the effective date |
|---|
| 35 | 35 | | of this Act. A claim filed before the effective date of this Act is |
|---|
| 36 | 36 | | governed by the law in effect on the date the claim was filed, and |
|---|
| 37 | 37 | | the former law is continued in effect for that purpose. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect January 1, 2026. |
