77 AN ACT
88 relating to initial claims under the unemployment compensation
99 system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 208.002(a), Labor Code, is amended to
1212 read as follows:
1313 Sec. 208.002. INITIAL CLAIM; LAST WORK. (a) When used in
1414 connection with an initial claim, "last work" and "person for whom
1515 the claimant last worked refers to :
1616 (1) the last person for whom the claimant actually
1717 worked, if the claimant worked for that person for at least 30 hours
1818 during a week; or
1919 (2) the employer, as defined by Subchapter C, Chapter
2020 201, or by the unemployment law of any other state, for whom the
2121 claimant last worked., unless otherwise required by state or
2222 federal law.
2323 (b) The commission shall mail a notice of the filing of an
2424 initial claim to the person for whom the claimant last worked before
2525 the effective date of the initial claim. If the person for whom the
2626 claimant last worked has more than one branch or division operating
2727 at different locations, the commission shall mail the notice to the
2828 branch or division at which the claimant last worked.
2929 (c) Mailing of a notice under this section to the correct
3030 address of the person, branch, or division for which the claimant
3131 last worked constitutes notice of the claim to the person.
3232 SECTION 2. The change in law made by this Act applies only
3333 to a claim for unemployment compensation benefits that is filed
3434 with the Texas Workforce Commission on or after the effective date
3535 of this Act. A claim filed before the effective date of this Act is
3636 governed by the law in effect on the date the claim was filed, and
3737 the former law is continued in effect for that purpose.
3838 SECTION 3. This Act takes effect January 1, 2026.
