108 AN ACT
119 relating to the authority of the board of regents of the Texas A&M
1210 University System to construct, acquire, improve, extend, and equip
1311 utility systems located on university system property.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1513 SECTION 1. Section 85.24, Education Code, is amended to
1614 read as follows:
1715 Sec. 85.24. UTILITIES. (a) The board [from time to time]
1816 may improve and equip existing [central] power plants and may
1917 construct, acquire, improve, and equip steam plants and additions
2018 to steam plants. For the purposes of this subsection, [them, and]
2119 the board may acquire property [land for these purposes] for the
2220 institutions under its control[,] when the total cost, type of
2321 construction, capacity, and plans and specifications have been
2422 approved by the board. As used in this section [subsection], "steam
2523 plants" does not include electrical generating facilities, but
2624 "[central] power plants" does include electrical generating
2725 facilities.
2826 (b) The board [from time to time] may construct, extend, and
2927 improve the water systems and [,] sewer systems[, or both,] for [any
3028 or] all institutions under its control[,] when the total cost, type
3129 of construction, capacity, and plans and specifications have been
3230 approved by the board.
3331 (c) The board may provide [furnish] water, sewer, steam,
3432 power, electricity, or any combination [or all] of those services
3533 from the [power and steam plant or] plants and other facilities
3634 located at each institution to [any or] all [dormitories, kitchens
3735 and dining halls, hospitals, student activity buildings,
3836 gymnasiums, athletic buildings and stadiums, the dormitory for
3937 help, laundry, and other] buildings or facilities that [may] have
4038 been or may be constructed at each institution, and may determine
4139 the amount to be charged as a part of the maintenance and operation
4240 expense of those buildings or facilities for the service or
4341 services. The board may allocate the cost of providing
4442 [furnishing] the services to revenue-producing buildings and
4543 facilities and to other buildings and facilities at the
4644 institutions. The board may pledge the net revenues from the
4745 amounts thus received for the services to pay the principal of and
4846 interest on, and to create and maintain the reserve for, the
4947 negotiable revenue bonds issued for the purpose of constructing,
5048 acquiring, improving, extending, or equipping the power and steam
5149 plants, or additions thereto, or other facilities, and may secure
5250 the bonds additionally by pledging rentals, rates, charges, and
5351 fees for the use or availability of all or any property, buildings,
5452 structures, activities, operations, or facilities, of any nature,
5553 which may be fixed and collected from all or any designated part of
5654 the students enrolled in the institution or institutions or from
5755 others in the amounts and in the manner determined and provided by
5856 the board in the resolution authorizing the issuance of the bonds.
5957 (d) In addition to the authority granted to the board under
6058 Subsections (a) and (b), the board may construct and acquire power
61- plants, and additions to power plants, located on university system
62- property in Brazos County and may acquire water systems and sewer
63- systems located on university system property in Brazos County.

6463 SECTION 2. This Act takes effect immediately if it receives
6564 a vote of two-thirds of all the members elected to each house, as
6665 provided by Section 39, Article III, Texas Constitution. If this
6766 Act does not receive the vote necessary for immediate effect, this
6867 Act takes effect September 1, 2025.
