10	8		AN ACT
11	9		relating to the authority of the board of regents of the Texas A&M
12	10		University System to construct, acquire, improve, extend, and equip
13	11		utility systems located on university system property.
14	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	13		SECTION 1. Section 85.24, Education Code, is amended to
16	14		read as follows:
17	15		Sec. 85.24. UTILITIES. (a) The board [from time to time]
18	16		may improve and equip existing [central] power plants and may
19	17		construct, acquire, improve, and equip steam plants and additions
20	18		to steam plants. For the purposes of this subsection, [them, and]
21	19		the board may acquire property [land for these purposes] for the
22	20		institutions under its control[,] when the total cost, type of
23	21		construction, capacity, and plans and specifications have been
24	22		approved by the board. As used in this section [subsection], "steam
25	23		plants" does not include electrical generating facilities, but
26	24		"[central] power plants" does include electrical generating
27	25		facilities.
28	26		(b) The board [from time to time] may construct, extend, and
29	27		improve the water systems and [,] sewer systems[, or both,] for [any
30	28		or] all institutions under its control[,] when the total cost, type
31	29		of construction, capacity, and plans and specifications have been
32	30		approved by the board.
33	31		(c) The board may provide [furnish] water, sewer, steam,
34	32		power, electricity, or any combination [or all] of those services
35	33		from the [power and steam plant or] plants and other facilities
36	34		located at each institution to [any or] all [dormitories, kitchens
37	35		and dining halls, hospitals, student activity buildings,
38	36		gymnasiums, athletic buildings and stadiums, the dormitory for
39	37		help, laundry, and other] buildings or facilities that [may] have
40	38		been or may be constructed at each institution, and may determine
41	39		the amount to be charged as a part of the maintenance and operation
42	40		expense of those buildings or facilities for the service or
43	41		services. The board may allocate the cost of providing
44	42		[furnishing] the services to revenue-producing buildings and
45	43		facilities and to other buildings and facilities at the
46	44		institutions. The board may pledge the net revenues from the
47	45		amounts thus received for the services to pay the principal of and
48	46		interest on, and to create and maintain the reserve for, the
49	47		negotiable revenue bonds issued for the purpose of constructing,
50	48		acquiring, improving, extending, or equipping the power and steam
51	49		plants, or additions thereto, or other facilities, and may secure
52	50		the bonds additionally by pledging rentals, rates, charges, and
53	51		fees for the use or availability of all or any property, buildings,
54	52		structures, activities, operations, or facilities, of any nature,
55	53		which may be fixed and collected from all or any designated part of
56	54		the students enrolled in the institution or institutions or from
57	55		others in the amounts and in the manner determined and provided by
58	56		the board in the resolution authorizing the issuance of the bonds.
59	57		(d) In addition to the authority granted to the board under
60	58		Subsections (a) and (b), the board may construct and acquire power
61		-	plants, and additions to power plants, located on university system
62		-	property in Brazos County and may acquire water systems and sewer
63		-	systems located on university system property in Brazos County.

64	63		SECTION 2. This Act takes effect immediately if it receives
65	64		a vote of two-thirds of all the members elected to each house, as
66	65		provided by Section 39, Article III, Texas Constitution. If this
67	66		Act does not receive the vote necessary for immediate effect, this
68	67		Act takes effect September 1, 2025.
