77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the applicability of certain laws governing public
1010 school requirements to a school district of innovation.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 12A.004(a), Education Code, is amended
1313 to read as follows:
1414 (a) A local innovation plan may not provide for the
1515 exemption of a district designated as a district of innovation from
1616 the following provisions of this title:
1717 (1) a state or federal requirement applicable to an
1818 open-enrollment charter school operating under Subchapter D,
1919 Chapter 12;
2020 (2) Subchapters A, C, D, and E, Chapter 11, except that
2121 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2222 Section 11.162;
2323 (3) Chapters 21 and 22;
2424 (4) class size limit requirements under Section
2525 25.112;
2626 (5) state curriculum and graduation requirements
2727 adopted under Chapter 28;
2828 (6) discipline and law and order under Chapter 37; and
2929 (7) [(4)] academic and financial accountability and
3030 sanctions under Chapters 39 and 39A.
3131 SECTION 2. Section 12A.004(a), Education Code, as amended
3232 by this Act, applies to each local innovation plan adopted under
3333 Chapter 12A, Education Code, regardless of whether the plan was
3434 adopted before, on, or after the effective date of this Act. A
3535 local innovation plan adopted or renewed before the effective date
3636 of this Act must comply with Section 12A.004(a), Education Code, as
3737 amended by this Act, not later than September 1, 2025.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2025.
