| 9 | 9 | | relating to the applicability of certain laws governing public |

| 10 | 10 | | school requirements to a school district of innovation. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 12A.004(a), Education Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (a) A local innovation plan may not provide for the |
|---|
| 15 | 15 | | exemption of a district designated as a district of innovation from |
|---|
| 16 | 16 | | the following provisions of this title: |
|---|
| 17 | 17 | | (1) a state or federal requirement applicable to an |
|---|
| 18 | 18 | | open-enrollment charter school operating under Subchapter D, |
|---|
| 19 | 19 | | Chapter 12; |
|---|
| 20 | 20 | | (2) Subchapters A, C, D, and E, Chapter 11, except that |
|---|
| 21 | 21 | | a district may be exempt from Sections 11.1511(b)(5) and (14) and |
|---|
| 22 | 22 | | Section 11.162; |
|---|
| 23 | 23 | | (3) Chapters 21 and 22; |
|---|
| 24 | 24 | | (4) class size limit requirements under Section |
|---|
| 25 | 25 | | 25.112; |
|---|
| 26 | 26 | | (5) state curriculum and graduation requirements |
|---|
| 27 | 27 | | adopted under Chapter 28; |
|---|
| 28 | 28 | | (6) discipline and law and order under Chapter 37; and |
|---|
| 29 | 29 | | (7) [(4)] academic and financial accountability and |
|---|
| 30 | 30 | | sanctions under Chapters 39 and 39A. |
|---|
| 31 | 31 | | SECTION 2. Section 12A.004(a), Education Code, as amended |
|---|
| 32 | 32 | | by this Act, applies to each local innovation plan adopted under |
|---|
| 33 | 33 | | Chapter 12A, Education Code, regardless of whether the plan was |
|---|
| 34 | 34 | | adopted before, on, or after the effective date of this Act. A |
|---|
| 35 | 35 | | local innovation plan adopted or renewed before the effective date |
|---|
| 36 | 36 | | of this Act must comply with Section 12A.004(a), Education Code, as |
|---|
| 37 | 37 | | amended by this Act, not later than September 1, 2025. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2025. |
