| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter B, Chapter 21, Transportation Code, | |
| 12 | 12 | is amended by adding Section 21.073 to read as follows: | |
| 13 | 13 | Sec. 21.073. PROTECTION OF CERTAIN AIRSPACE. (a) In this | |
| 14 | 14 | section, "aerobatic training area" means a long-term aerobatic | |
| 15 | 15 | practice area designated by the Federal Aviation Administration on | |
| 16 | 16 | or before January 1, 2025. | |
| 17 | 17 | (b) A person may not construct a structure taller than 500 | |
| 18 | 18 | feet within five miles of an aerobatic training area that is used | |
| 19 | 19 | for training by a person who contracts with the United States | |
| 20 | 20 | Department of Defense for aviation services. | |
| 21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
| 22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
| 23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
| 24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
| 25 | 25 | Act takes effect September 1, 2025. |
