77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the offense of passing certain vehicles on a highway.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 545.157(a), Transportation Code, is
1212 amended to read as follows:
1313 (a) This section applies only to the following vehicles:
1414 (1) a stationary authorized emergency vehicle using
1515 visual signals that meet the requirements of Sections 547.305 and
1616 547.702;
1717 (2) a stationary tow truck using equipment authorized
1818 by Section 547.305(d);
1919 (3) a Texas Department of Transportation vehicle or a
2020 highway maintenance or construction vehicle operated pursuant to a
2121 contract awarded under Subchapter A, Chapter 223, not separated
2222 from the roadway by a traffic control channelizing device and using
2323 visual signals that comply with the standards and specifications
2424 adopted under Section 547.105;
2525 (4) a service vehicle used by or for a utility, as
2626 defined by Section 203.091, and using visual signals that comply
2727 with the standards and specifications adopted under Section
2828 547.105;
2929 (5) a stationary vehicle used exclusively to transport
3030 municipal solid waste, as defined by Section 361.003, Health and
3131 Safety Code, or recyclable material, as defined by Section 361.421,
3232 Health and Safety Code, while being operated in connection with the
3333 removal or transportation of municipal solid waste or recyclable
3434 material from a location adjacent to the highway; [and]
3535 (6) a vehicle operated by or pursuant to a contract
3636 with a toll project entity, as defined by Section 372.001, using
3737 visual signals that comply with the standards and specifications
3838 adopted under Section 547.105; and
3939 (7) a vehicle stopped on the shoulder of the highway or
4040 adjacent to the highway and using hazard lamps that comply with
4141 Section 547.331.
4242 SECTION 2. This Act takes effect September 1, 2025.
