88 AN ACT
99 relating to a grant program to fund certain railroad grade
1010 separation projects.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 471, Transportation Code, is amended by
1313 adding Section 471.010 to read as follows:
1414 Sec. 471.010. GRANT PROGRAM FOR CERTAIN RAILROAD GRADE
1515 SEPARATION PROJECTS. (a) For the purpose of increasing public
1616 safety, enhancing economic development, and reducing traffic, the
1717 department shall establish and administer a program to award grants
1818 to political subdivisions of this state or railroad companies to
1919 fund:
2020 (1) rail-roadway grade separation projects that are
2121 located at intersections of railroads and roadways that are not
2222 part of the state highway system; and
2323 (2) rail-pedestrian grade separation projects that
2424 are located at intersections of railroads and pedestrian crossings.
2525 (b) A political subdivision or railroad company may use
2626 money awarded by the department under this section as matching
2727 funds to secure additional funding for a grade separation project
2828 described by Subsection (a).
2929 (c) Each grant awarded under this section must be approved
3030 by the commission. The commission may not approve a grant under
3131 this section unless the commission determines that:
3232 (1) at least 10 percent of the total project costs will
3333 be provided by a source other than the state; or
3434 (2) if the grant money is being used as matching funds
3535 under Subsection (b), at least 10 percent of the amount used as
3636 matching funds will be provided by a source other than the state.
3737 (d) The department may fund the grant program under this
3838 section only from money appropriated by the legislature for that
3939 purpose and from gifts and grants, including grants from the
4040 federal government. The department may solicit and accept gifts
4141 and grants from any source for the purposes of this section. Money
4242 deposited to the credit of the state highway fund may not be used to
4343 fund a grant awarded under this section.
4444 (e) The commission shall adopt rules as necessary to
4545 implement this section.
4646 SECTION 2. Not later than October 1, 2025, the Texas
4747 Transportation Commission shall adopt the rules required by Section
4848 471.010, Transportation Code, as added by this Act.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2025.
