9 | 9 | | relating to a grant program to fund certain railroad grade |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 471, Transportation Code, is amended by |
---|
13 | 13 | | adding Section 471.010 to read as follows: |
---|
14 | 14 | | Sec. 471.010. GRANT PROGRAM FOR CERTAIN RAILROAD GRADE |
---|
15 | 15 | | SEPARATION PROJECTS. (a) For the purpose of increasing public |
---|
16 | 16 | | safety, enhancing economic development, and reducing traffic, the |
---|
17 | 17 | | department shall establish and administer a program to award grants |
---|
18 | 18 | | to political subdivisions of this state or railroad companies to |
---|
19 | 19 | | fund: |
---|
20 | 20 | | (1) rail-roadway grade separation projects that are |
---|
21 | 21 | | located at intersections of railroads and roadways that are not |
---|
22 | 22 | | part of the state highway system; and |
---|
23 | 23 | | (2) rail-pedestrian grade separation projects that |
---|
24 | 24 | | are located at intersections of railroads and pedestrian crossings. |
---|
25 | 25 | | (b) A political subdivision or railroad company may use |
---|
26 | 26 | | money awarded by the department under this section as matching |
---|
27 | 27 | | funds to secure additional funding for a grade separation project |
---|
28 | 28 | | described by Subsection (a). |
---|
29 | 29 | | (c) Each grant awarded under this section must be approved |
---|
30 | 30 | | by the commission. The commission may not approve a grant under |
---|
31 | 31 | | this section unless the commission determines that: |
---|
32 | 32 | | (1) at least 10 percent of the total project costs will |
---|
33 | 33 | | be provided by a source other than the state; or |
---|
34 | 34 | | (2) if the grant money is being used as matching funds |
---|
35 | 35 | | under Subsection (b), at least 10 percent of the amount used as |
---|
36 | 36 | | matching funds will be provided by a source other than the state. |
---|
37 | 37 | | (d) The department may fund the grant program under this |
---|
38 | 38 | | section only from money appropriated by the legislature for that |
---|
39 | 39 | | purpose and from gifts and grants, including grants from the |
---|
40 | 40 | | federal government. The department may solicit and accept gifts |
---|
41 | 41 | | and grants from any source for the purposes of this section. Money |
---|
42 | 42 | | deposited to the credit of the state highway fund may not be used to |
---|
43 | 43 | | fund a grant awarded under this section. |
---|
44 | 44 | | (e) The commission shall adopt rules as necessary to |
---|
45 | 45 | | implement this section. |
---|
46 | 46 | | SECTION 2. Not later than October 1, 2025, the Texas |
---|
47 | 47 | | Transportation Commission shall adopt the rules required by Section |
---|
48 | 48 | | 471.010, Transportation Code, as added by this Act. |
---|
49 | 49 | | SECTION 3. This Act takes effect immediately if it receives |
---|
50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
---|
51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
---|
53 | 53 | | Act takes effect September 1, 2025. |
