77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the creation of a public information campaign to raise
1010 awareness of the Texas Compassionate Use Program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) The legislature finds that:
1313 (1) the Texas Compassionate Use Program provides legal
1414 access to low-THC cannabis for patients with certain medical
1515 conditions;
1616 (2) many eligible patients, caregivers, and health
1717 care providers are unaware of the program and the program's
1818 benefits; and
1919 (3) increasing public awareness will ensure that more
2020 qualifying patients can access this medical treatment.
2121 (b) The purpose of this Act is to establish a statewide
2222 public information campaign to educate the public and health care
2323 providers about the Texas Compassionate Use Program.
2424 SECTION 2. Chapter 487, Health and Safety Code, is amended
2525 by adding Subchapter G to read as follows:
2626 SUBCHAPTER G. PUBLIC AWARENESS CAMPAIGN
2727 Sec. 487.301. DEFINITION. In this subchapter, "program"
2828 means the compassionate use program established under this chapter.
2929 Sec. 487.302. PUBLIC INFORMATION CAMPAIGN. (a) The
3030 department shall develop and implement a public information
3131 campaign to raise awareness of the program using various
3232 communication channels to disseminate information regarding the
3333 program.
3434 (b) The campaign must:
3535 (1) provide accurate, evidence-based information on
3636 eligibility, enrollment, and access to the program;
3737 (2) target eligible patients, caregivers, health care
3838 professionals, and the general public;
3939 (3) use multiple media platforms, including:
4040 (A) a dedicated Internet website and online
4141 resources;
4242 (B) social media campaigns;
4343 (C) television and radio advertisements;
4444 (D) print materials and billboards; and
4545 (E) educational materials for health care
4646 providers; and
4747 (4) partner with medical associations, patient
4848 advocacy groups, and local health departments to enhance outreach
4949 efforts.
5050 Sec. 487.303. BUDGET; FUNDING. (a) The department shall
5151 prepare a projected budget estimate detailing anticipated costs,
5252 including media production, distribution, and outreach activities.
5353 (b) The department may use any funds appropriated or
5454 otherwise made available for the purposes of the campaign and
5555 accept gifts, grants, and donations to fund the campaign.
5656 (c) The department may seek federal and private funding
5757 sources to ensure the campaign's implementation.
5858 Sec. 487.304. REPORTING REQUIREMENTS. (a) The department,
5959 in collaboration with relevant stakeholders, shall analyze key
6060 performance indicators to measure the campaign's success and shall
6161 annually submit a report to the legislature assessing the
6262 effectiveness of the campaign and suggesting necessary adjustments
6363 to improve the campaign.
6464 (b) The report required by Subsection (a) must include:
6565 (1) information regarding the implementation and
6666 reach of the public information campaign;
6767 (2) metrics on public awareness before and after the
6868 campaign; and
6969 (3) recommendations for improving outreach efforts.
7070 Sec. 487.305. RULES. (a) The department shall adopt rules
7171 necessary to implement this subchapter, including rules governing
7272 the content, format, and distribution of public information
7373 materials regarding the program. The rules adopted by the
7474 department must:
7575 (1) ensure that all public information materials are
7676 consistent with state law and medical guidelines;
7777 (2) establish a process for periodic review and
7878 updates of public information materials to reflect current
7979 scientific research and legal changes; and
8080 (3) define the scope and limitations of the
8181 department's authority in overseeing the public information
8282 campaign.
8383 (b) The department shall provide a mechanism for public and
8484 stakeholder input in the rulemaking process.
8585 SECTION 3. (a) Not later than January 1, 2026, the
8686 Department of Public Safety shall implement the public awareness
8787 campaign required by Subchapter G, Chapter 487, Health and Safety
8888 Code, as added by this Act.
8989 (b) Not later than December 31, 2026, the Department of
9090 Public Safety shall submit to the legislature the first report
9191 required by Section 487.304, Health and Safety Code, as added by
9292 this Act.
9393 SECTION 4. This Act takes effect September 1, 2025.
