| 9 | 9 | | relating to chemicals and techniques used in weather modification |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 301, Agriculture Code, is |
|---|
| 13 | 13 | | amended by adding Section 301.118 to read as follows: |
|---|
| 14 | 14 | | Sec. 301.118. USE OF CERTAIN CHEMICALS AND TECHNIQUES. (a) |
|---|
| 15 | 15 | | A license holder may not use a chemical or technique for weather |
|---|
| 16 | 16 | | modification and control unless the chemical or technique has been |
|---|
| 17 | 17 | | approved by the Texas Department of Licensing and Regulation for |
|---|
| 18 | 18 | | that use. |
|---|
| 19 | 19 | | (b) The Texas Department of Licensing and Regulation may not |
|---|
| 20 | 20 | | approve a chemical or technique for use in weather modification and |
|---|
| 21 | 21 | | control if the chemical or technique is known to cause harm to human |
|---|
| 22 | 22 | | health, including harm to the human endocrine, nervous, |
|---|
| 23 | 23 | | respiratory, or reproductive system, when used for that purpose. |
|---|
| 24 | 24 | | (c) In determining whether to approve a chemical or |
|---|
| 25 | 25 | | technique for use in weather modification and control, the Texas |
|---|
| 26 | 26 | | Department of Licensing and Regulation may obtain the assistance |
|---|
| 27 | 27 | | of: |
|---|
| 28 | 28 | | (1) the Department of Agriculture; |
|---|
| 29 | 29 | | (2) the Texas Commission on Environmental Quality; |
|---|
| 30 | 30 | | (3) the Health and Human Services Commission; or |
|---|
| 31 | 31 | | (4) any other entity the Texas Department of Licensing |
|---|
| 32 | 32 | | and Regulation deems appropriate. |
|---|
| 33 | 33 | | (d) The Texas Department of Licensing and Regulation shall |
|---|
| 34 | 34 | | adopt rules necessary to implement this section. |
|---|
| 35 | 35 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 36 | 36 | | of this Act, the Texas Department of Licensing and Regulation shall |
|---|
| 37 | 37 | | adopt rules as required by Section 301.118, Agriculture Code, as |
|---|
| 38 | 38 | | added by this Act. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2025. |
