| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 51.9092 to read as follows: |
|---|
| 15 | 15 | | Sec. 51.9092. SWORN STATEMENT BY FOREIGN STUDENT OR |
|---|
| 16 | 16 | | EMPLOYEE. (a) In this section, "institution of higher education" |
|---|
| 17 | 17 | | has the meaning assigned by Section 61.003. |
|---|
| 18 | 18 | | (b) This section applies only to a student or employee who |
|---|
| 19 | 19 | | is not a citizen or lawful permanent resident of the United States. |
|---|
| 20 | 20 | | (c) An institution of higher education shall require a |
|---|
| 21 | 21 | | student enrolled at or employee of the institution to sign and |
|---|
| 22 | 22 | | submit to the institution a statement certifying that the student |
|---|
| 23 | 23 | | or employee is not an agent of a foreign adversary. |
|---|
| 24 | 24 | | (d) A sworn statement under this section must include the |
|---|
| 25 | 25 | | following: |
|---|
| 26 | 26 | | "By signing this document, I affirm that I am not an agent of |
|---|
| 27 | 27 | | a foreign nation hostile to the United States of America or the |
|---|
| 28 | 28 | | State of Texas." |
|---|
| 29 | 29 | | (e) The Texas Higher Education Coordinating Board may adopt |
|---|
| 30 | 30 | | rules as necessary for the administration of this section. |
|---|
| 31 | 31 | | SECTION 2. Section 51.9092, Education Code, as added by |
|---|
| 32 | 32 | | this Act, applies to a student enrolled at or employee of a public |
|---|
| 33 | 33 | | institution of higher education regardless of whether the student |
|---|
| 34 | 34 | | or employee was enrolled at or hired by the institution before, on, |
|---|
| 35 | 35 | | or after the effective date of this Act. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2025. |
