77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring a sworn statement by certain foreign students
1010 enrolled at or employees of public institutions of higher
1111 education.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1414 amended by adding Section 51.9092 to read as follows:
1515 Sec. 51.9092. SWORN STATEMENT BY FOREIGN STUDENT OR
1616 EMPLOYEE. (a) In this section, "institution of higher education"
1717 has the meaning assigned by Section 61.003.
1818 (b) This section applies only to a student or employee who
1919 is not a citizen or lawful permanent resident of the United States.
2020 (c) An institution of higher education shall require a
2121 student enrolled at or employee of the institution to sign and
2222 submit to the institution a statement certifying that the student
2323 or employee is not an agent of a foreign adversary.
2424 (d) A sworn statement under this section must include the
2525 following:
2626 "By signing this document, I affirm that I am not an agent of
2727 a foreign nation hostile to the United States of America or the
2828 State of Texas."
2929 (e) The Texas Higher Education Coordinating Board may adopt
3030 rules as necessary for the administration of this section.
3131 SECTION 2. Section 51.9092, Education Code, as added by
3232 this Act, applies to a student enrolled at or employee of a public
3333 institution of higher education regardless of whether the student
3434 or employee was enrolled at or hired by the institution before, on,
3535 or after the effective date of this Act.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2025.
