| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Subchapter Z, Chapter 51, Education Code, is | |
| 13 | 13 | amended by adding Section 51.988 to read as follows: | |
| 14 | 14 | Sec. 51.988. PROHIBITION ON INSTRUCTION REGARDING GENDER | |
| 15 | 15 | PRONOUNS. (a) In this section, "institution of higher education" | |
| 16 | 16 | has the meaning assigned by Section 61.003. | |
| 17 | 17 | (b) An institution of higher education may not provide | |
| 18 | 18 | instruction that promotes the use of a gender pronoun inconsistent | |
| 19 | 19 | with a person's biological sex. | |
| 20 | 20 | (c) The Texas Higher Education Coordinating Board shall | |
| 21 | 21 | adopt rules as necessary to implement this section. | |
| 22 | 22 | SECTION 2. This Act applies beginning with the 2025-2026 | |
| 23 | 23 | academic year. | |
| 24 | 24 | SECTION 3. This Act takes effect immediately if it receives | |
| 25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
| 26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
| 27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
| 28 | 28 | Act takes effect September 1, 2025. |
