77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting public institutions of higher education
1010 from providing instruction regarding the use of gender pronouns.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1313 amended by adding Section 51.988 to read as follows:
1414 Sec. 51.988. PROHIBITION ON INSTRUCTION REGARDING GENDER
1515 PRONOUNS. (a) In this section, "institution of higher education"
1616 has the meaning assigned by Section 61.003.
1717 (b) An institution of higher education may not provide
1818 instruction that promotes the use of a gender pronoun inconsistent
1919 with a person's biological sex.
2020 (c) The Texas Higher Education Coordinating Board shall
2121 adopt rules as necessary to implement this section.
2222 SECTION 2. This Act applies beginning with the 2025-2026
2323 academic year.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2025.
