88 AN ACT
99 relating to crime victims' compensation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 56B.102, Code of Criminal Procedure, is
1212 amended by amending Subsection (a) and adding Subsection (d) to
1313 read as follows:
1414 (a) The [Before acting on an application for compensation
1515 under this chapter, the] attorney general may make an emergency
1616 award for anticipated pecuniary losses if it appears likely that:
1717 (1) a final award will be made; and
1818 (2) the claimant or victim will suffer undue hardship
1919 if immediate economic relief is not obtained.
2020 (d) The limitations on emergency awards described by
2121 Subsections (a)(1) and (c) do not apply to an application for
2222 compensation under this chapter:
2323 (1) made by a claimant in relation to a deceased
2424 victim; and
2525 (2) arising from criminally injurious conduct that
2626 resulted in a proclaimed state of emergency under Section 433.001,
2727 Government Code.
2828 SECTION 2. Article 56B.102, Code of Criminal Procedure, as
2929 amended by this Act, applies only to compensation for criminally
3030 injurious conduct occurring on or after the effective date of this
3131 Act. Compensation for criminally injurious conduct occurring
3232 before the effective date of this Act is governed by the law in
3333 effect on the date the conduct occurred, and the former law is
3434 continued in effect for that purpose. For purposes of this section,
3535 criminally injurious conduct occurred before the effective date of
3636 this Act if any element of the offense underlying the conduct
3737 occurred before that date.
3838 SECTION 3. This Act takes effect September 1, 2025.
