12- in marketing about the availability of certain private health
13- benefit plan coverage.
9+ relating to allowing Medicaid managed care organizations to inform
10+ Medicaid recipients about the availability of certain private
11+ health benefit plan coverage.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1513 SECTION 1. Section 540.0055, Government Code, as effective
1614 April 1, 2025, is amended by adding Subsection (c) to read as

1816 (c) The marketing guidelines the commission establishes
1917 under this section may not prohibit a Medicaid managed care
20- organization from:
21- (1) informing an individual, including a current or
22- former recipient, about the availability of qualified health plans
23- offered through an exchange, as the terms "exchange" and "qualified
24- health plan" are defined by 45 C.F.R. Section 155.20; or
25- (2) advertising a Medicare Advantage plan or related
26- benefit offered under Part C of Title XVIII of the Social Security
27- Act (42 U.S.C. Section 1395w-21 et seq.) at a community enrollment
28- or other event.

2922 SECTION 2. If before implementing any provision of this Act
3023 a state agency determines that a waiver or authorization from a
3124 federal agency is necessary for implementation of that provision,
3225 the agency affected by the provision shall request the waiver or
3326 authorization and may delay implementing that provision until the
3427 waiver or authorization is granted.
3528 SECTION 3. This Act takes effect September 1, 2025.
