77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the creation of the Texas Southern University College
1010 of Medicine at Texas Southern University.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 106, Education Code, is amended by
1313 adding Subchapter E to read as follows:
1414 SUBCHAPTER E. TEXAS SOUTHERN UNIVERSITY COLLEGE OF MEDICINE
1515 Sec. 106.61. DEFINITIONS. In this subchapter:
1616 (1) "Board" means the board of regents of Texas
1717 Southern University.
1818 (2) "College" means the Texas Southern University
1919 College of Medicine established under this subchapter.
2020 Sec. 106.62. THE TEXAS SOUTHERN UNIVERSITY COLLEGE OF
2121 MEDICINE. The Texas Southern University College of Medicine is a
2222 college of Texas Southern University and is under the management
2323 and control of the board with degrees offered under the name and
2424 authority of Texas Southern University.
2525 Sec. 106.63. COURSES AND DEGREES. The board may prescribe
2626 courses leading to customary degrees and may adopt rules for the
2727 operation, control, and management of the college as necessary for
2828 conducting a college of medicine of the first class.
2929 Sec. 106.64. AFFILIATION AGREEMENTS. The dean of the
3030 college, on behalf of the board, may execute and carry out an
3131 affiliation or coordinating agreement with any other entity or
3232 institution in the college's region.
3333 Sec. 106.65. GIFTS AND GRANTS. The board may solicit,
3434 accept, and administer gifts and grants from any public or private
3535 source for the use and benefit of the college.
3636 Sec. 106.66. OTHER FACILITIES. In addition to the
3737 college's facilities, the board may enter into agreements under
3838 which additional facilities used in the college's teaching and
3939 research programs, including libraries, auditoriums, research
4040 facilities, and medical education buildings, may be provided by a
4141 public or private entity.
4242 Sec. 106.67. TEACHING HOSPITAL. A teaching hospital
4343 considered suitable by the board may be provided by a public or
4444 private entity. The hospital may not be constructed, maintained,
4545 or operated with state funds.
4646 SECTION 2. Section 59.01(3), Education Code, is amended to
4747 read as follows:
4848 (3) "Board" means the board of regents of The
4949 University of Texas System, the board of regents of The Texas A&M
5050 University System, the board of regents of the Texas Tech
5151 University System, the board of regents of the Texas State
5252 University System, the board of regents of the University of
5353 Houston System, the board of regents of Stephen F. Austin State
5454 University, the board of regents of Texas Southern University, or
5555 the board of regents of the University of North Texas System.
5656 SECTION 3. Sections 59.02(a) and (c), Education Code, are
5757 amended to read as follows:
5858 (a) Each board may establish a separate self-insurance fund
5959 to pay any damages adjudged in a court of competent jurisdiction or
6060 a settlement of any health care liability claim against a health
6161 care professional staff member or student arising from the exercise
6262 of the member's or student's appointment, duties, or training with
6363 The University of Texas System, The Texas A&M University System,
6464 the Texas Tech University System, the Texas State University
6565 System, the University of Houston System, Stephen F. Austin State
6666 University, the Texas Southern University College of Medicine, or
6767 the University of North Texas System.
6868 (c) On the establishment of each fund, transfers to the fund
6969 shall be made in an amount and at such intervals as determined by
7070 the board. Each board may receive and accept any gifts or donations
7171 specified for the purposes of this subchapter and deposit those
7272 gifts or donations into the fund. Each board may invest money
7373 deposited in the fund, and any income received shall be retained in
7474 the fund. The money shall be deposited in any of the approved
7575 depository banks of The University of Texas System, The Texas A&M
7676 University System, the Texas Tech University System, the Texas
7777 State University System, the University of Houston System, Stephen
7878 F. Austin State University, Texas Southern University, or the
7979 University of North Texas System. All expenditures from the funds
8080 shall be paid pursuant to approval by the boards.
8181 SECTION 4. Section 59.06, Education Code, is amended to
8282 read as follows:
8383 Sec. 59.06. LIMITATION ON APPROPRIATED FUNDS. Funds
8484 appropriated by the legislature to The University of Texas System,
8585 The Texas A&M University System, the Texas Tech University System,
8686 the Texas State University System, the University of Houston
8787 System, Texas Southern University for the Texas Southern University
8888 College of Medicine, or the University of North Texas System from
8989 the General Revenue Fund may not be used to establish or maintain
9090 the fund, to purchase insurance, or to employ private legal
9191 counsel.
9292 SECTION 5. Section 61.003(5), Education Code, is amended to
9393 read as follows:
9494 (5) "Medical and dental unit" means The Texas A&M
9595 University System Health Science Center and its component
9696 institutions, agencies, and programs; the Texas Tech University
9797 Health Sciences Center; the Texas Tech University Health Sciences
9898 Center at El Paso; the University of Houston College of Medicine;
9999 the Sam Houston State University College of Osteopathic Medicine;
100100 The University of Texas Medical Branch at Galveston; The University
101101 of Texas Southwestern Medical Center; The University of Texas
102102 Medical School at San Antonio; The University of Texas Dental
103103 Branch at Houston; The University of Texas M. D. Anderson Cancer
104104 Center; The University of Texas Graduate School of Biomedical
105105 Sciences at Houston; The University of Texas Dental School at San
106106 Antonio; The University of Texas Medical School at Houston; the
107107 Dell Medical School at The University of Texas at Austin; the School
108108 of Medicine at The University of Texas Rio Grande Valley; the
109109 nursing institutions of The Texas A&M University System and The
110110 University of Texas System; and The University of Texas School of
111111 Public Health at Houston; the Texas Southern University College of
112112 Medicine; and such other medical or dental schools as may be
113113 established by statute or as provided in this chapter.
114114 SECTION 6. Section 61.501(1), Education Code, is amended to
115115 read as follows:
116116 (1) "Medical school" means the medical school at The
117117 University of Texas Health Science Center at Houston, the medical
118118 school at The University of Texas Southwestern Medical Center, the
119119 medical school at The University of Texas Health Science Center at
120120 San Antonio, The University of Texas Medical Branch at Galveston,
121121 the medical school at The University of Texas at Austin, the medical
122122 school at The University of Texas Rio Grande Valley, the medical
123123 education program of The University of Texas Health Science Center
124124 at Tyler, the medical school at the Texas Tech University Health
125125 Sciences Center, the medical school at the Texas Tech University
126126 Health Sciences Center at El Paso, the Sam Houston State University
127127 College of Osteopathic Medicine, the University of Houston College
128128 of Medicine, the Baylor College of Medicine, the college of
129129 osteopathic medicine at the University of North Texas Health
130130 Science Center at Fort Worth, the Texas Southern University College
131131 of Medicine, or the medical school at the Texas A&M University
132132 Health Science Center.
133133 SECTION 7. Section 63.002(c), Education Code, is amended to
134134 read as follows:
135135 (c) The amount available for distribution from the fund may
136136 be appropriated only for programs that benefit medical research,
137137 health education, or treatment programs at the following
138138 health-related institutions of higher education:
139139 (1) The University of Texas Health Science Center at
140140 San Antonio;
141141 (2) The University of Texas M. D. Anderson Cancer
142142 Center;
143143 (3) The University of Texas Southwestern Medical
144144 Center;
145145 (4) The University of Texas Medical Branch at
146146 Galveston;
147147 (5) The University of Texas Health Science Center at
148148 Houston;
149149 (6) The University of Texas Health Science Center at
150150 Tyler;
151151 (7) The University of Texas Health Science
152152 Center--South Texas and its component institutions, if established
153153 under Subchapter N, Chapter 74;
154154 (8) The Texas A&M University Health Science Center;
155155 (9) the University of North Texas Health Science
156156 Center at Fort Worth;
157157 (10) the Texas Tech University Health Sciences Center;
158158 (11) the Texas Tech University Health Sciences Center
159159 at El Paso;
160160 (12) the University of Houston College of Medicine;
161161 (13) the Sam Houston State University College of
162162 Osteopathic Medicine;
163163 (14) the Dell Medical School at The University of
164164 Texas at Austin; [and]
165165 (15) the Texas Southern University College of
166166 Medicine; and
167167 (16) Baylor College of Medicine, if a contract between
168168 Baylor College of Medicine and the Texas Higher Education
169169 Coordinating Board is in effect under Section 61.092.
170170 SECTION 8. This Act takes effect immediately if it receives
171171 a vote of two-thirds of all the members elected to each house, as
172172 provided by Section 39, Article III, Texas Constitution. If this
173173 Act does not receive the vote necessary for immediate effect, this
174174 Act takes effect September 1, 2025.
