11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 106, Education Code, is amended by |
---|
13 | 13 | | adding Subchapter E to read as follows: |
---|
14 | 14 | | SUBCHAPTER E. TEXAS SOUTHERN UNIVERSITY COLLEGE OF MEDICINE |
---|
15 | 15 | | Sec. 106.61. DEFINITIONS. In this subchapter: |
---|
16 | 16 | | (1) "Board" means the board of regents of Texas |
---|
17 | 17 | | Southern University. |
---|
18 | 18 | | (2) "College" means the Texas Southern University |
---|
19 | 19 | | College of Medicine established under this subchapter. |
---|
20 | 20 | | Sec. 106.62. THE TEXAS SOUTHERN UNIVERSITY COLLEGE OF |
---|
21 | 21 | | MEDICINE. The Texas Southern University College of Medicine is a |
---|
22 | 22 | | college of Texas Southern University and is under the management |
---|
23 | 23 | | and control of the board with degrees offered under the name and |
---|
24 | 24 | | authority of Texas Southern University. |
---|
25 | 25 | | Sec. 106.63. COURSES AND DEGREES. The board may prescribe |
---|
26 | 26 | | courses leading to customary degrees and may adopt rules for the |
---|
27 | 27 | | operation, control, and management of the college as necessary for |
---|
28 | 28 | | conducting a college of medicine of the first class. |
---|
29 | 29 | | Sec. 106.64. AFFILIATION AGREEMENTS. The dean of the |
---|
30 | 30 | | college, on behalf of the board, may execute and carry out an |
---|
31 | 31 | | affiliation or coordinating agreement with any other entity or |
---|
32 | 32 | | institution in the college's region. |
---|
33 | 33 | | Sec. 106.65. GIFTS AND GRANTS. The board may solicit, |
---|
34 | 34 | | accept, and administer gifts and grants from any public or private |
---|
35 | 35 | | source for the use and benefit of the college. |
---|
36 | 36 | | Sec. 106.66. OTHER FACILITIES. In addition to the |
---|
37 | 37 | | college's facilities, the board may enter into agreements under |
---|
38 | 38 | | which additional facilities used in the college's teaching and |
---|
39 | 39 | | research programs, including libraries, auditoriums, research |
---|
40 | 40 | | facilities, and medical education buildings, may be provided by a |
---|
41 | 41 | | public or private entity. |
---|
42 | 42 | | Sec. 106.67. TEACHING HOSPITAL. A teaching hospital |
---|
43 | 43 | | considered suitable by the board may be provided by a public or |
---|
44 | 44 | | private entity. The hospital may not be constructed, maintained, |
---|
45 | 45 | | or operated with state funds. |
---|
46 | 46 | | SECTION 2. Section 59.01(3), Education Code, is amended to |
---|
47 | 47 | | read as follows: |
---|
48 | 48 | | (3) "Board" means the board of regents of The |

49 | 49 | | University of Texas System, the board of regents of The Texas A&M |
---|
50 | 50 | | University System, the board of regents of the Texas Tech |

56 | 56 | | SECTION 3. Sections 59.02(a) and (c), Education Code, are |

58 | 58 | | (a) Each board may establish a separate self-insurance fund |

59 | 59 | | to pay any damages adjudged in a court of competent jurisdiction or |
---|
60 | 60 | | a settlement of any health care liability claim against a health |
---|
61 | 61 | | care professional staff member or student arising from the exercise |
---|
62 | 62 | | of the member's or student's appointment, duties, or training with |
---|
63 | 63 | | The University of Texas System, The Texas A&M University System, |
---|
64 | 64 | | the Texas Tech University System, the Texas State University |
---|
65 | 65 | | System, the University of Houston System, Stephen F. Austin State |
---|

68 | 68 | | (c) On the establishment of each fund, transfers to the fund |
---|
69 | 69 | | shall be made in an amount and at such intervals as determined by |
---|
70 | 70 | | the board. Each board may receive and accept any gifts or donations |
---|
71 | 71 | | specified for the purposes of this subchapter and deposit those |
---|
72 | 72 | | gifts or donations into the fund. Each board may invest money |
---|
73 | 73 | | deposited in the fund, and any income received shall be retained in |
---|
74 | 74 | | the fund. The money shall be deposited in any of the approved |
---|
75 | 75 | | depository banks of The University of Texas System, The Texas A&M |
---|
76 | 76 | | University System, the Texas Tech University System, the Texas |
---|
77 | 77 | | State University System, the University of Houston System, Stephen |
---|
78 | 78 | | F. Austin State University, Texas Southern University, or the |
---|
79 | 79 | | University of North Texas System. All expenditures from the funds |
---|
80 | 80 | | shall be paid pursuant to approval by the boards. |
---|
81 | 81 | | SECTION 4. Section 59.06, Education Code, is amended to |
---|

172 | 172 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
173 | 173 | | Act does not receive the vote necessary for immediate effect, this |
---|
174 | 174 | | Act takes effect September 1, 2025. |
