8	8	AN ACT
9	9	relating to the creation of the Texas Southern University College
10	10	of Medicine at Texas Southern University.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Chapter 106, Education Code, is amended by
13	13	adding Subchapter E to read as follows:
14	14	SUBCHAPTER E. TEXAS SOUTHERN UNIVERSITY COLLEGE OF MEDICINE
15	15	Sec. 106.61. DEFINITIONS. In this subchapter:
16	16	(1) "Board" means the board of regents of Texas
17	17	Southern University.
18	18	(2) "College" means the Texas Southern University
19	19	College of Medicine established under this subchapter.
20	20	Sec. 106.62. THE TEXAS SOUTHERN UNIVERSITY COLLEGE OF
21	21	MEDICINE. The Texas Southern University College of Medicine is a
22	22	college of Texas Southern University and is under the management
23	23	and control of the board with degrees offered under the name and
24	24	authority of Texas Southern University.
25	25	Sec. 106.63. COURSES AND DEGREES. The board may prescribe
26	26	courses leading to customary degrees and may adopt rules for the
27	27	operation, control, and management of the college as necessary for
28	28	conducting a college of medicine of the first class.
29	29	Sec. 106.64. AFFILIATION AGREEMENTS. The dean of the
30	30	college, on behalf of the board, may execute and carry out an
31	31	affiliation or coordinating agreement with any other entity or
32	32	institution in the college's region.
33	33	Sec. 106.65. GIFTS AND GRANTS. The board may solicit,
34	34	accept, and administer gifts and grants from any public or private
35	35	source for the use and benefit of the college.
36	36	Sec. 106.66. OTHER FACILITIES. In addition to the
37	37	college's facilities, the board may enter into agreements under
38	38	which additional facilities used in the college's teaching and
39	39	research programs, including libraries, auditoriums, research
40	40	facilities, and medical education buildings, may be provided by a
41	41	public or private entity.
42	42	Sec. 106.67. TEACHING HOSPITAL. A teaching hospital
43	43	considered suitable by the board may be provided by a public or
44	44	private entity. The hospital may not be constructed, maintained,
45	45	or operated with state funds.
46	46	SECTION 2. Section 59.01(3), Education Code, is amended to
47	47	read as follows:
48	48	(3) "Board" means the board of regents of The
49	49	University of Texas System, the board of regents of The Texas A&M
50	50	University System, the board of regents of the Texas Tech
51	51	University System, the board of regents of the Texas State
52	52	University System, the board of regents of the University of
53	53	Houston System, the board of regents of Stephen F. Austin State
54	54	University, the board of regents of Texas Southern University, or
55	55	the board of regents of the University of North Texas System.
56	56	SECTION 3. Sections 59.02(a) and (c), Education Code, are
57	57	amended to read as follows:
58	58	(a) Each board may establish a separate self-insurance fund
59	59	to pay any damages adjudged in a court of competent jurisdiction or
60	60	a settlement of any health care liability claim against a health
61	61	care professional staff member or student arising from the exercise
62	62	of the member's or student's appointment, duties, or training with
63	63	The University of Texas System, The Texas A&M University System,
64	64	the Texas Tech University System, the Texas State University
65	65	System, the University of Houston System, Stephen F. Austin State
66	66	University, the Texas Southern University College of Medicine, or
67	67	the University of North Texas System.
68	68	(c) On the establishment of each fund, transfers to the fund
69	69	shall be made in an amount and at such intervals as determined by
70	70	the board. Each board may receive and accept any gifts or donations
71	71	specified for the purposes of this subchapter and deposit those
72	72	gifts or donations into the fund. Each board may invest money
73	73	deposited in the fund, and any income received shall be retained in
74	74	the fund. The money shall be deposited in any of the approved
75	75	depository banks of The University of Texas System, The Texas A&M
76	76	University System, the Texas Tech University System, the Texas
77	77	State University System, the University of Houston System, Stephen
78	78	F. Austin State University, Texas Southern University, or the
79	79	University of North Texas System. All expenditures from the funds
80	80	shall be paid pursuant to approval by the boards.
81	81	SECTION 4. Section 59.06, Education Code, is amended to
82	82	read as follows:
83	83	Sec. 59.06. LIMITATION ON APPROPRIATED FUNDS. Funds
84	84	appropriated by the legislature to The University of Texas System,
85	85	The Texas A&M University System, the Texas Tech University System,
86	86	the Texas State University System, the University of Houston
87	87	System, Texas Southern University for the Texas Southern University
88	88	College of Medicine, or the University of North Texas System from
89	89	the General Revenue Fund may not be used to establish or maintain
90	90	the fund, to purchase insurance, or to employ private legal
91	91	counsel.
92	92	SECTION 5. Section 61.003(5), Education Code, is amended to
93	93	read as follows:
94	94	(5) "Medical and dental unit" means The Texas A&M
95	95	University System Health Science Center and its component
96	96	institutions, agencies, and programs; the Texas Tech University
97	97	Health Sciences Center; the Texas Tech University Health Sciences
98	98	Center at El Paso; the University of Houston College of Medicine;
99	99	the Sam Houston State University College of Osteopathic Medicine;
100	100	The University of Texas Medical Branch at Galveston; The University
101	101	of Texas Southwestern Medical Center; The University of Texas
102	102	Medical School at San Antonio; The University of Texas Dental
103	103	Branch at Houston; The University of Texas M. D. Anderson Cancer
104	104	Center; The University of Texas Graduate School of Biomedical
105	105	Sciences at Houston; The University of Texas Dental School at San
106	106	Antonio; The University of Texas Medical School at Houston; the
107	107	Dell Medical School at The University of Texas at Austin; the School
108	108	of Medicine at The University of Texas Rio Grande Valley; the
109	109	nursing institutions of The Texas A&M University System and The
110	110	University of Texas System; and The University of Texas School of
111	111	Public Health at Houston; the Texas Southern University College of
112	112	Medicine; and such other medical or dental schools as may be
113	113	established by statute or as provided in this chapter.
114	114	SECTION 6. Section 61.501(1), Education Code, is amended to
115	115	read as follows:
116	116	(1) "Medical school" means the medical school at The
117	117	University of Texas Health Science Center at Houston, the medical
118	118	school at The University of Texas Southwestern Medical Center, the
119	119	medical school at The University of Texas Health Science Center at
120	120	San Antonio, The University of Texas Medical Branch at Galveston,
121	121	the medical school at The University of Texas at Austin, the medical
122	122	school at The University of Texas Rio Grande Valley, the medical
123	123	education program of The University of Texas Health Science Center
124	124	at Tyler, the medical school at the Texas Tech University Health
125	125	Sciences Center, the medical school at the Texas Tech University
126	126	Health Sciences Center at El Paso, the Sam Houston State University
127	127	College of Osteopathic Medicine, the University of Houston College
128	128	of Medicine, the Baylor College of Medicine, the college of
129	129	osteopathic medicine at the University of North Texas Health
130	130	Science Center at Fort Worth, the Texas Southern University College
131	131	of Medicine, or the medical school at the Texas A&M University
132	132	Health Science Center.
133	133	SECTION 7. Section 63.002(c), Education Code, is amended to
134	134	read as follows:
135	135	(c) The amount available for distribution from the fund may
136	136	be appropriated only for programs that benefit medical research,
137	137	health education, or treatment programs at the following
138	138	health-related institutions of higher education:
139	139	(1) The University of Texas Health Science Center at
140	140	San Antonio;
141	141	(2) The University of Texas M. D. Anderson Cancer
142	142	Center;
143	143	(3) The University of Texas Southwestern Medical
144	144	Center;
145	145	(4) The University of Texas Medical Branch at
146	146	Galveston;
147	147	(5) The University of Texas Health Science Center at
148	148	Houston;
149	149	(6) The University of Texas Health Science Center at
150	150	Tyler;
151	151	(7) The University of Texas Health Science
152	152	Center--South Texas and its component institutions, if established
153	153	under Subchapter N, Chapter 74;
154	154	(8) The Texas A&M University Health Science Center;
155	155	(9) the University of North Texas Health Science
156	156	Center at Fort Worth;
157	157	(10) the Texas Tech University Health Sciences Center;
158	158	(11) the Texas Tech University Health Sciences Center
159	159	at El Paso;
160	160	(12) the University of Houston College of Medicine;
161	161	(13) the Sam Houston State University College of
162	162	Osteopathic Medicine;
163	163	(14) the Dell Medical School at The University of
164	164	Texas at Austin; [and]
165	165	(15) the Texas Southern University College of
166	166	Medicine; and
167	167	(16) Baylor College of Medicine, if a contract between
168	168	Baylor College of Medicine and the Texas Higher Education
169	169	Coordinating Board is in effect under Section 61.092.
170	170	SECTION 8. This Act takes effect immediately if it receives
171	171	a vote of two-thirds of all the members elected to each house, as
172	172	provided by Section 39, Article III, Texas Constitution. If this
173	173	Act does not receive the vote necessary for immediate effect, this
174	174	Act takes effect September 1, 2025.
