77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to biometric identifiers used in the performance of
1010 artificial intelligence.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 503.001, Business & Commerce Code, is
1313 amended by amending Subsection (a) and adding Subsection (f) to
1414 read as follows:
1515 (a) In this section:
1616 (1) "Artificial intelligence" means the use of machine
1717 learning and related technologies that use data to train
1818 statistical models for the purpose of enabling computer systems to
1919 perform tasks normally associated with human intelligence or
2020 perception, including computer vision, speech or natural language
2121 processing, and content generation.
2222 (2) "Biometric [, "biometric] identifier" means a
2323 retina or iris scan, fingerprint, voiceprint, or record of hand or
2424 face geometry.
2525 (f) This section does not apply to artificial intelligence
2626 or related training, processing, or storage, unless performed for
2727 the purpose of uniquely identifying a specific individual. If a
2828 biometric identifier captured for the commercial purpose of
2929 artificial intelligence is used for another and separate commercial
3030 purpose, the person possessing the biometric identifier is subject
3131 to this section's provisions for the possession and destruction of
3232 a biometric identifier and the associated penalties.
3333 SECTION 2. This Act takes effect September 1, 2025.
