11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 503.001, Business & Commerce Code, is |
---|
13 | 13 | | amended by amending Subsection (a) and adding Subsection (f) to |
---|
14 | 14 | | read as follows: |

15 | 15 | | (a) In this section: |
---|
16 | 16 | | (1) "Artificial intelligence" means the use of machine |
---|
17 | 17 | | learning and related technologies that use data to train |
---|
18 | 18 | | statistical models for the purpose of enabling computer systems to |
---|
19 | 19 | | perform tasks normally associated with human intelligence or |
---|
20 | 20 | | perception, including computer vision, speech or natural language |
---|
21 | 21 | | processing, and content generation. |
---|
22 | 22 | | (2) "Biometric [, "biometric] identifier" means a |
---|
23 | 23 | | retina or iris scan, fingerprint, voiceprint, or record of hand or |
---|
24 | 24 | | face geometry. |
---|
25 | 25 | | (f) This section does not apply to artificial intelligence |
---|
26 | 26 | | or related training, processing, or storage, unless performed for |
---|
27 | 27 | | the purpose of uniquely identifying a specific individual. If a |
---|
28 | 28 | | biometric identifier captured for the commercial purpose of |
---|
29 | 29 | | artificial intelligence is used for another and separate commercial |
---|
30 | 30 | | purpose, the person possessing the biometric identifier is subject |
---|
31 | 31 | | to this section's provisions for the possession and destruction of |
---|
32 | 32 | | a biometric identifier and the associated penalties. |
---|
33 | 33 | | SECTION 2. This Act takes effect September 1, 2025. |
