57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to the plan for the operation of a central counting
810 station.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 127.007, Election Code, is amended by
1113 amending Subsections (b) and (c) and adding Subsections (d) and (e)
1214 to read as follows:
1315 (b) The plan required under this section must include:
1416 (1) information on [address] the process for comparing
1517 the number of voters who signed the combination form or electronic
1618 poll list with the number of votes cast for the entire election;
1719 (2) who will provide information to the presiding
1820 judge of the central counting station to complete the
1921 reconciliation of votes and voters conducted under Section
2022 127.131(f);
2123 (3) the date, time, and location of the second and
2224 third logic and accuracy tests to be conducted at the central
2325 counting station or regional tabulating center serving the central
2426 counting station and the procedures regarding an unsuccessful logic
2527 and accuracy test;
2628 (4) the date, time, and place the central counting
2729 station will operate before, on, and after election day, as
2830 applicable;
2931 (5) the names of the tabulation supervisor, central
3032 counting station manager, presiding judge, and alternate presiding
3133 judge and the party affiliations of the presiding judge and
3234 alternate presiding judge in the central counting stations and
3335 regional tabulating center serving the central counting station, as
3436 applicable;
3537 (6) the procedure regarding ballot security,
3638 including ballot storage and chain of custody procedures from the
3739 time the central counting station or regional tabulating center
3840 receives a sealed ballot box under Section 127.068 through the
3941 period for preserving the precinct election records under Section
4042 66.058; and
4143 (7) information regarding the livestream available to
4244 the public under Section 127.1232.
4345 (c) Not later than the fifth day before election day:
4446 (1) the [The] plan required under this section must be
4547 posted on the county's Internet website in the same location that
4648 the county clerk provides information on elections held by the
4749 county; and
4850 (2) a copy of the plan, including the contact
4951 information of the persons described by Subsection (b)(5), must be
5052 provided to the members of the county election board [available to
5153 the public on request not later than 5 p.m. on the fifth day before
5254 the date of the election].
5355 (d) If a plan required by this section is revised after the
5456 date the plan is posted in accordance with Subsection (c), the
5557 county's Internet website must be updated to include:
5658 (1) the plan with incorporated revisions; and
5759 (2) either:
5860 (A) a list with the date of each revision and the
5961 section revised; or
6062 (B) a revised version of the plan conspicuously
6163 displaying each revision and the date of those revisions.
6264 (e) The contact information of a person described by
6365 Subsection (b)(5) is not subject to disclosure under Chapter 552,
6466 Government Code.
6567 SECTION 2. This Act takes effect September 1, 2025.
