9 | 9 | | relating to money awarded to providers of women's health services |
---|
10 | 10 | | and family planning services, including the repeal of prohibitions |
---|
11 | 11 | | on the provision of those services. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 526.0051, Government Code, as effective |
---|
14 | 14 | | April 1, 2025, is amended to read as follows: |
---|
15 | 15 | | Sec. 526.0051. [RESTRICTIONS ON] AWARDS TO FAMILY PLANNING |
---|
16 | 16 | | SERVICE PROVIDERS. (a) Notwithstanding any other law, money |
---|
17 | 17 | | appropriated to the commission for the purpose of providing family |
---|
18 | 18 | | planning services must be awarded[: |
---|
19 | 19 | | [(1)] to eligible public and nonpublic entities that |
---|
20 | 20 | | provide family planning services in the following order of |
---|
21 | 21 | | descending priority: |
---|
22 | 22 | | (1) entities with a demonstrated, evidence-based, |
---|
23 | 23 | | historical capability of achieving the patient and service |
---|
24 | 24 | | utilization goals the commission establishes for family planning |
---|
25 | 25 | | services; and |
---|
26 | 26 | | (2) entities with an increased probability of |
---|
27 | 27 | | achieving the goals described by Subdivision (1)[(A) public |
---|
28 | 28 | | entities that provide family planning services, including state, |
---|
29 | 29 | | county, and local community health clinics and federally qualified |
---|
30 | 30 | | health centers; |
---|
31 | 31 | | [(B) nonpublic entities that provide |
---|
32 | 32 | | comprehensive primary and preventive care services in addition to |
---|
33 | 33 | | family planning services; and |
---|
34 | 34 | | [(C) nonpublic entities that provide family |
---|
35 | 35 | | planning services but do not provide comprehensive primary and |
---|
36 | 36 | | preventive care services; or |
---|
37 | 37 | | [(2) as otherwise directed by the legislature in the |
---|
38 | 38 | | General Appropriations Act]. |
---|
39 | 39 | | (b) Notwithstanding Subsection (a), the commission shall, |
---|
40 | 40 | | in compliance with federal law, ensure distribution of funds for |
---|
41 | 41 | | family planning services in a manner that provides equitable [does |
---|
42 | 42 | | not severely limit or eliminate] access to [those] services in all |
---|
43 | 43 | | regions [any region] of this state. |
---|
44 | 44 | | SECTION 2. The following provisions are repealed: |
---|
45 | 45 | | (1) Chapter 2273, Government Code; and |
---|
46 | 46 | | (2) Section 32.024(c-1), Human Resources Code. |
---|
47 | 47 | | SECTION 3. This Act takes effect September 1, 2025. |
