77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to money awarded to providers of women's health services
1010 and family planning services, including the repeal of prohibitions
1111 on the provision of those services.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 526.0051, Government Code, as effective
1414 April 1, 2025, is amended to read as follows:
1515 Sec. 526.0051. [RESTRICTIONS ON] AWARDS TO FAMILY PLANNING
1616 SERVICE PROVIDERS. (a) Notwithstanding any other law, money
1717 appropriated to the commission for the purpose of providing family
1818 planning services must be awarded[:
1919 [(1)] to eligible public and nonpublic entities that
2020 provide family planning services in the following order of
2121 descending priority:
2222 (1) entities with a demonstrated, evidence-based,
2323 historical capability of achieving the patient and service
2424 utilization goals the commission establishes for family planning
2525 services; and
2626 (2) entities with an increased probability of
2727 achieving the goals described by Subdivision (1)[(A) public
2828 entities that provide family planning services, including state,
2929 county, and local community health clinics and federally qualified
3030 health centers;
3131 [(B) nonpublic entities that provide
3232 comprehensive primary and preventive care services in addition to
3333 family planning services; and
3434 [(C) nonpublic entities that provide family
3535 planning services but do not provide comprehensive primary and
3636 preventive care services; or
3737 [(2) as otherwise directed by the legislature in the
3838 General Appropriations Act].
3939 (b) Notwithstanding Subsection (a), the commission shall,
4040 in compliance with federal law, ensure distribution of funds for
4141 family planning services in a manner that provides equitable [does
4242 not severely limit or eliminate] access to [those] services in all
4343 regions [any region] of this state.
4444 SECTION 2. The following provisions are repealed:
4545 (1) Chapter 2273, Government Code; and
4646 (2) Section 32.024(c-1), Human Resources Code.
4747 SECTION 3. This Act takes effect September 1, 2025.
