12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Subchapter B, Chapter 382, Health and Safety | |
14 | 14 | Code, is amended by adding Section 382.0292 to read as follows: | |
15 | 15 | Sec. 382.0292. PUBLIC HEARING FOR HIGH LEVELS OF BENZENE. | |
16 | 16 | (a) If monitoring or modeling data indicates an area is exceeding | |
17 | 17 | or likely exceeding a national or state ambient air quality | |
18 | 18 | standard for benzene, the commission shall hold a public hearing in | |
19 | 19 | the area to allow interested persons to present comments relating | |
20 | 20 | to the elevated levels of benzene. | |
21 | 21 | (b) The commission shall provide notice of a public hearing | |
22 | 22 | held under Subsection (a) at least once in a newspaper of general | |
23 | 23 | circulation in the area in which the hearing is to be held. The | |
24 | 24 | notice must be published not later than the 30th day before the date | |
25 | 25 | of the hearing. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2025. |
